Quite realising that the readers of the blog Avenues2 (tapovan976.org) might be experiencing lot of a problem in getting apprised of the latest developments in different service matters particularly in relation to the cases pending in several courts of law in the country after it was unscrupulously hacked by certain vested interests, a via media has since been worked out for the time being by creating a NewsPage page in my another blog Avenues (uppermost.me), a blog which was predecessor to Avenues2. If the arrangement suits the readers and works well, necessary steps would be taken to regularise it. Since KR Saini, a veteran on pension issues and other industrial matters, was good enough to contribute sumptuously in the earlier NEWS PAGE in Avenues2, he is being requested along with Rajkumar Negi, another veteran in the field,  to take up the task in this blog too and hopefully this may equally work well in the interest of the readers. The updates may have to be there in the form of comments only like earlier.

Mr K.R.Saini has once again narrated the whole ,(*all cases ) pending in the different High Courts and the bad intention of the Govt as well as the judiciary.Why the supreme court has transferred the case to Delhi High Court and why our lawyer accepted it to transfer the case to delhi high court knowingly that one case of Smt bagga is already pending in the same court for the last twelve years. It shows there is some arrangement in between the lawyers , , these lawyers are only for their fees and not for the timely decission of the case. there should be a contempt case against the Delhi High Court not obeying the instructions of Supreme court to decide the case with in given time fram i.e.six months. I do not have any hope on the delhi high court, I have reached 69 and the case will not be decided in next five years as per speed of the case in the court, and the date given after the gape of six months.I have already seen in the other case of smt prem vatti bagga (seven persons filed the case and only one is alive ) filed in the same court
    Now after the change in the Govt , there might be some hope under Sh Narendra Modi .

Our senior friends who spent golden days of their life in the bank. Now the Bank/GOVT deceiving them. The Bank is offering them a LOLLY POP as dishonorable gift at the age of 80 plus out of their own funds cheated by the Bank. A huge amount of pension & Dearness Allowance of 30000 loyal & devoted workers is hold with the Bank for the last 15/17years in spite of several court decisions.
      Now the Bank is offering a petty amount as Good Will pack to our senior colleagues at the time of 60th anniversary of its inception. Our federation should not only appeal to the seniors of above 80 years to openly refuse to accept the disgraceful goodwill pack but also say to the Bank that we are not baggers. IF THE BANK HAS LEAST RESPECT TO THEIR WORKERS IT MAY BE A GOOD GESTURE BY THE BANK TO CONCEDE ON THE EVE OF THE 60TH ANNIVERSARY OF FORMATION OF SBI THE JUST & REASONABLE DEMAND OF 30000 & ODD 7TH BIPARTITE RETIREES NOT WITHSTANDING THE STATUS OF THE PENDING COURT CASES. The progressive thinking Govt. under the dynamic leadership of Shri Narendra Modi Ji should also not stand on false prestige and give approval for the Bank’ proposal for revision of pension of 5th, 6th and 7th BPS retirees forthwith. If the announcement comes on the eve of 1st July 2015 that is 60 years of inception of SBI, it will be more than the Good Will Package offered to just a few hundreds of pensioners who have crossed 80 years and above. The gesture will be cherished by more than 15000 surviving 7th BPS pensioners of 30000 and odd eligible pensioners (patiently waiting for more than 15 years) can be expect that some good sense will prevail on the Top Management of the Bank and the officials of the Finance Ministry and RBI in this regard.??

IF THE BANK HAS LEAST RESPECT TO THEIR WORKERS IT MAY BE A GOOD GESTURE BY THE BANK TO CONCEDE ON THE EVE OF THE 60TH ANNIVERSARY OF FORMATION OF SBI THE JUST & REASONABLE DEMAND OF 30000 & ODD 7TH BIPARTITE RETIREES NOT WITHSTANDING THE STATUS OF THE PENDING COURT CASES. The progressive thinking Govt. under the dynamic leadership of Shri Narendra Modi Ji should also not stand on false prestige and give approval for the Bank’ proposal for revision of pension of 5th, 6th and 7th BPS retirees forthwith. If the announcement comes on the eve of 1st July 2015 that is 60 years of inception of SBI, it will be more than the Good Will Package offered to just a few hundreds of pensioners who have crossed 80 years and above. The gesture will be cherished by more than 15000 surviving 7th BPS pensioners of 30000 and odd eligible pensioners (patiently waiting for more than 15 years) can be expect that some good sense will prevail on the Top Management of the Bank and the officials of the Finance Ministry and RBI in this regard.??

    The Court:-By this writ petition the petitioner seeks to challenge the
    orders dated 18th May, 2007, 24th June, 2009 and 31st July, 2009 whereby his
    representation for re-examination of the sanctioned pension was considered and
    rejected on the basis of the revision effected on 1st November, 1992.
    The case of the petitioner is that he retired from service on 30th
    November, 2001. As he was an awardee staff of the respondent no.1, his
    pensionary benefits were to be governed under the 1955 Pension Rules of the
    respondent no.1. Rule 23 of the 1955 Rules is applicable to the petitioner and
    thereunder 50 % of the last three years pay should be considered for computing 2
    pensionary benefits. Clause 16 of the 7th bipartite settlement deals with pension
    and pay for purposes of pension is as drawn in terms of the 6th bipartite
    settlement. This is subject to the amendments to be made to the 1995
    Regulation, which do not apply to the petitioner. But the amendments must be
    made to the 1955 Pension Rules of the State Bank of India.
    Although under 7th bipartite settlement revision of pay was effected
    and the said revised pay was received by the petitioner. Without making such
    payment applicable to the petitioner at the time of computing pension, the pay
    drawn under the 6th bipartite settlement has been made applicable. This is
    contrary to the Pension Rules of 1955. Even assuming that the 6th bipartite
    settlement is applicable, there was revision of pay in 1992 and the amount
    received by the petitioner was below Rs.8,500/-. Therefore, a calculation must be
    made on the basis of the second proviso [a] of Rule 23 and as this has not been
    done nor pension calculated on the revised pay of the 7th bipartite settlement
    warrants interference by this Court. From the information received under the
    2005 Act, there has been no amendment to the 1955 Rules. Therefore, as there
    has been no amendment, unamended provision of the 1955 Rules will apply.
    In opposing the said application it has been submitted by counsel
    for the respondent bank that 1995 Regulations are not applicable to the
    employees or the awardee staff of the State Bank of India. The 7th bipartite
    settlement was effected in 2000 and the representation made on 4th April, 2007.
    In the said representation the petitioner has sought for the application of the
    revised pay fixed under the 7th bipartite settlement. The said premise is incorrect 3
    in view of Rule 16 of the 7th bipartite settlement. Therefore, the representation
    made by the petitioner has been rejected by the orders passed. The pension
    Rules, 1955 have been amended as will appear from the Gazette Notification
    dated 31st March, 2001. Prior to the said amendment an amendment was
    published on 16th September, 2000. The said amendment effected and published
    on 16th September, 2000 deals with the second proviso to Rule 23 and Rule 2[A]
    of Rule 23. Therefore, there can be no dispute that the amendment has been
    effected and the pensionary benefits has been calculated as per the 6th bipartite
    settlement as indicated in Clause 16 of the 7th bipartite settlement. Therefore,
    this application calls for no interference and the same be dismissed.
    In reply, counsel for the petitioner submits that the respondent
    No.1 is guided by its own set of Pension Rules of 1955. The dispute is in respect
    of fixation of pay, which will govern the pensionary benefits payable to the
    petitioner. The Pension Rules of the Bank of Baroda are in consonance with the
    1955 Rules and postulate payment of 50% of the average allowance drawn by an
    employee. Reliance is placed on AIR 1983 SC 130 for the proposition that
    pension is no longer a bounty but is a right governed by the Rules. Although
    pension has been paid, it has been calculated on the basis of pay under the 6th
    bipartite settlement, which is unjustified. Therefore, orders be passed.
    Having considered the submissions of the parties, the only issue
    that needs to be considered is with regard to pay on the basis of which the
    pensionary benefits are to be calculated. The 7th bipartite settlement is dated 19th
    May, 2000. Clause 16 specifically provides that pay for purposes of pension is the 4
    amount drawn in terms of the 6th bipartite settlement. But this is subject to the
    amendments that may be made to the provisions of the 1995 Regulations. In the
    instant case, 1995 Regulations have no application as the employees of the State
    Bank of India are governed by the 1955 Pension Rules. Therefore, they belong to
    a separate class and their pensionary benefits are to be governed by the 1955
    Rules. As pay for purposes of pension is the 6th bipartite settlement under the
    7th bipartite settlement subject to the amendment of the Regulations and from
    the documents placed by the respondent bank before the court, this day at
    hearing, it appears that the second proviso and Clause [a] and [b] thereunder of
    Rule 23 were published on 16th September, 2000. This is what will govern the
    petitioner admittedly. In the 7th bipartite settlement application of 6th bipartite
    settlement has been made for purposes of ascertaining pay but this again is
    subject to the amendment. The petitioner retired on 30th November, 2001 by
    which time the 7th bipartite settlement was in existence and the revision of pay
    had also been effected thereunder. In fact, at the time of retirement the petitioner
    was receiving the revised pay under the 7th bipartite settlement. Therefore, this
    ought to have been made the basis while calculating his pensionary benefits. The
    7th bipartite settlement came into effect on and from 1st November, 1997 for a
    period of five years, i.e., till 2002. Rule 23 of 1955 Rules postulates an average to
    be taken of the last twelve months. Admittedly, in the last twelve months, the
    petitioner was receiving pay under the 7th bipartite settlement and therefore, the
    application of pay received under the 6th bipartite settlement by the respondent
    no.1 for calculating the petitioner’s pensionary benefits is unjustified. 5
    Accordingly, the respondent no.1 is directed to calculate the
    pensionary benefits of the petitioner on the basis of the revised pay received by
    him under the 7th bipartite settlement, as the pensionary benefits have been
    disbursed to the petitioner since his retirement within two weeks from the date of
    receipt of the order. On a calculation made on the basis mentioned above, if
    sums are found due and payable to the petitioner, the said sums be paid within
    three weeks thereof.
    In view of the aforesaid, this application succeeds and is,
    accordingly, disposed of.
    Urgent certified photocopy of this order, if applied for, be supplied to
    the parties subject to compliance with all requisite formalities.

If the announcement comes on the eve of 1st July 2015 that is 60 years of inception of SBI, it will be more than the Good Will Package offered to just a few hundreds of pensioners who have crossed 80 years and above.     It is still not clear whether the Bank is going to make payment as per High Court Order or going for appeal against the judgment . In this connection Shri R.C. Upadhyaya retired General Manager has written in his letter regarding above case on 28 June 2015 on pension issues to the Chair Person of SBI as under:-

    It is indeed truly shocking that the management under your leadership too has chosen to file a review of the judgment delivered on 6-4-2015 in the Jaipuriar casein the Delhi High Court.The Bank having considerable financial resources at its command have been such sinister moves with a view to wearing down RETIREES who have been facing severe financial crunch non receipt of pension from the Bank.

    In this connection Shri Gopalakrishna Iyer has mentioned in his post dated 16-6-2015 that he had discussion with a leading lawyer of High Court of Karnataka that in his Opinion Bank cannot appeal against the order as the petitioner i.e Shri Jaipuriyar withdrew his petition only upon a commitment made by the Bank’s lawyers to accede to his prayer. In the circumstances, the only way for the Bank is to make payment.

    Please look into the matter in the light of above two comments and let the pensioners know as to what is the actual position in the above case.

    The pensioners could not hear the fate of the above Delhi High Court order although the 12 weeks time given by the Hon’ble Delhi High Court to re-compute the pension payable to the pensioner by taking into account the last 12 months salary received by him and arrears to be paid within a period of 12 weeks from today. Can any body tell us whether the Bank has made the payment as per Hon’ble High Court order or filed any revision petition or appeal against the above order.

  97. The above case is being postponed for the last 6th July 2015 without hearing and without any valid reason. When the WP 184 was transferred to Delhi High Court on27-2-2013 for some technical reasons it was specifically mentioned in the transfer order of Supreme Court as under:-

    The Honorable Supreme Court in their order dated 27-2-2013 specifically mentioned that the pleadings are complete and the matter is pending before this court for the last one and a half years we deem it proper to transfer the petition papers to Delhi High Court and request the learned Chief Justice to assign the writ petition before a bench of his choice for early disposal of the matter at any rate within the outer limit of six months from the date of receipt of records. It is surprising that when we people ignore/disobey the order of court it is treated contempt of court but if Delhi High Court is not adhering to the request/instructions of apex Court it is no contempt. It is clear that the might is always right.

    It appears that there is no discipline in our judicial system. I am afraid that this case will not be decided with in this 21st century. Since more than 50% aggrieved pensioners have left this world and remaining have crossed their age of 70 and waiting for the call of the God.

After all he is getting pension from the Bank.There should not be any discrimatin about 60 yrs. or less one an employee is entitle to get pension , he should be entitle to get all the medical facilities at par with other pensioners.     PLIGHT OF THE 7TH BIPARTITE RETIREES
    I joined the Bank in the year 1964 and served the Bank for 37 Years. Since then I had never seen that our Bank has any time have taken any discriminatory decision, affecting its Staff. Only in the year 2000 on receiving administrative instructions from the MOF, the Bank issued instructions to its LHO’s that the Pension of all the 7th Bipartite retirees be fixed on the pre-revised salary of the 6th Bipartite retirees. Those instructions of the MOF and those of the Bank don’t have the force of Law and are in violation of the SBI Employees Pension Fund Rules, 1955 (now known as SBI Pension Fund Regulations-2014) and in violation of the provisions of the SBI Act. The provisions of the art. 300 of the Constitution of India are also violated by issuing the aforesaid unconstitutional instructions.
    2. In terms of the SBI Act our Central Board is fully empowered to take decisions as to the payment of pensions as stipulated in the Act and the Regulations and the Pension Fund Rules. The Act does not empower the C.G./MOF in that behalf. The Act also does not empower the C. G./MOF to interfere in to the day today affairs of the Bank and those in respect of its staff, except only where Public interest is involved. The C.G./MOF approval is required for establishment and maintenance of the Pension Fund. By the Bank’s unnecessarily seeking approval/permission of the CG/MOF, they have assumed extra-constitutional authority and unwarrantedly interfering where they are not empowered to by the Act.
    3. In this regard our Bank’s retired General Manager, Shri PP Ramchandra Upadhyaya has already very elaborately submitted to you to kindly take an initiative to rectify the anomalies created as a result of the wrong decisions of the Govt. and that of the Bank.
    4. I hope the matter may kindly receive your personal attention and you may kindly initiate steps, if required by consulting the Bank’s Solicitors; to rectify the aforesaid mistakes done in the past, as early as possible, so that the justice is done to the Pensioners in the age group of 71 to 80 years, counting the last days of their life.

On going through the factual position brought to the notice of the Bank’s Chairman, we pensioners are rather in a dilemma as to why the Bank unnecessarily refers to the CG/MOF when in terms of the sub-section 1 of Section 17 of SBI Act (23 of 1955), the Central Board is empowered under SBI EPR to make pension payments to its pensioners.
    Secondly, whether the Federation has emphasized over this point to our Chairman in the Structural Meetings. Similarly, whether the points mentioned in letters of Shri. PPR Upadhyaya, are brought to the notice of the High Court/Supreme Court, in the cases still pending for hearing. Hope to receive a line in reply from you.

      SBI pensioners stage dharna, press for ‘legitimate’ pension

      THE pensioners of State Bank of India (SBI) staged dharna at Samvidhan Square here on Friday, and sought ‘legitimate’ pension based on last drawn pay. The pensioners staged demonstrations under the banner of All India SBI (7thBipartite)Pensioners’ Forum. At the outset, the pensioners garlanded portraits of Mahatma Gandhi and Dr Babasaheb Ambedkar. Jayant Vakil, Convener of the Forum, inaugurated the dharna programme. He said that the pensioners would take their peaceful protests to the next level and agitate at Rajghat. “Give us the pension on last-drawn salary as per rules. However, SBI management and the Government of India have denied this basic right to 40,000 SBI pensioners for 18 years,” he said. Madhukarrao Gadge presided over the programme.   160. One lac State Bank of India Pensioners will agitate at Rajghat – Jayant Vakil

    Give us the Pension on the last drawn pay as per rules is what the State Bank of india (7th Bi-partite) Pensioners’ are demanding.
    However, the management of State Bank of India and the Government of India, Ministry of Finance have denied this basic right of the workers to 40,000 SBI pensioners since last 18 years. This is causing great resentment to the pensioners as the act of administration is not only illegal but also inhuman.
    The Bank Management and The Ministry of Finance should immediately reconsider their adamant stand otherwise the pensioners, taking inspiration from Mahatma Gandhi and Bharat Ratna Babasaheb Ambedkar would take their peaceful protest to the next level and agitate at Rajghat next – was declared by the 78 years old Shri Jayant Vakil, convener of All India SBI Pensioners’ Forum and the senior most member among the 7th Bi-partite pensioners, while inaugurating the Dharna Programme on 2nd October at Samvidhan Square, Nagpur
    He further said that while the pensioner is paid pension on the lower salary he drew under the previous (6th Bipartite scales of pay) during his life time, the family pension is paid on the actual salary paid at the time of retirement, which in other words means that to get justice the pensioner has to die. We will not rest and continue to agitate till the Government is forced to change its inhuman approach to our problem, he asserted.
    The Dharna Programme was presided over by Shri Madhukarrao Ghadge, Shri Anil Pimplapure conducted the programme and Shri Dilip Chouguley proposed a vote of thanks. S/ Shri C.N.     Why don’t we – members of State Bank of India Pensioners Association/Federation host a POST CARD sending protest campaign against the willful dragging of our pension issues ,such as the eligible pension refixation of d 7th Bipartite retiree pensioners of SBI on the basis of their last received salary and allowances and 100% DA neutralization on pension along with d updation of Pension.
    Now it is learned that our case in Delhi High Court No 1875 /2013 is again postponed to 28th August 16.Whatever may be d reason we the ordinary members feel that there is some foul play behind such actions.Hence I think it is high time on the part of you ( the Federation) to intiate some protest against such inordinate delay in arriving a verdict, as almost all pensioners related to this case are above the age group of 75 years

State Bank Employees prov/Pension Rules were replaced in Sept 2014; Sh Jaipuria/his lawyer prepared writ on this line & got relief as it was for the Bank’s Board of Directors to decide fixation of pension. Govt of India was made a respondent unnecessarily. It is on record that Ld Court had asked federation to redraft writ. Is then it be assumed that the writ was for payment of 50% pension uniformly unlike arbitrarily being done? Can’t say as the writ has not been. We pensioners want a) 50% of last basic pay drawn, b) revision of pension of 7th Bipartite retirees, c) 100% neutralization of DA & d) family pension @ 40%.(To be contd pl wait for post# 3). Regards

    one pensiner wins the case and get revised pension why not all? How the Bank is paying revised pension to one and different pension to others? Will the pension rules allows such disparities? If the news is correct why not the federation take up to the knowledge of HC orSc? Waiting for any good time?
