Pension issues still procrastinate!

Patience of retirees in State Bank of India, the biggest and oldest Bank in the country still overbrinking, the ray of hope the retirees have all along been nourishing is terribly drawn to zero point as if the issue of  retirees sustenance is of just a trivial firmament warranting no attention from the relative channels, administrative and judicial both. Why do they forget that the aggrieved lot are the most legitimate electorate of the country with a voice just not derailable to vacuum. The very comment, as made by KR Saini below is much worth a serious reading gone through in a meticulous order:

  • PENDING AT DELHI HIGH COURT—NEXT DATE OF HEARING IS 24.01.2019.
  • AS YOU ARE AWARE THAT THE PENSION ISSUES THAT CONCERNS EXCLUSIVELLY THE RETIRED PEOPLE PARTICULARLY OLD PENSIONERS(WHO ARE ABOVE 70 YEARS TO 85 YEARS OLD),VERY MUCH A WRONG SIDE OF AGE-IT IS SURPRISING THAT OUR COURT CASE NO W.P(C)1875/2013 WHICH WAS TRANSFERRED TO DELHI HIGH COURT FOR DISPOSAL FROM SUPPREME COURT ON SOME TECHNICAAL GROUNDS ON 27.02.2013.ALTHOUGH OUR THIS COURT CASE WAS COMPLETELY HEARD IN SUPREME COURT OFINDIA MORE THAN ONE AND HALF YEAR.BUT THE BANK AND GOVERNMENT HAD SUCCEEDED IN GETTING ITTRANSFERRED TO DELHIHIGH COURT ON SOME TECHNICAL GROUNDS WITH A VIEW TO PROLONG IT FURTHER,THE OBVIOUS REASON FOR THE SUPREME COURT TO DIVERT OUR WRIT PETITION TO DELHI HIGH COURT IS THE ADAMANT STAND OF CENTRAL GOVERNMENT.
  • HONOURABLE SUPREME COURT IN THEIR ORDER ON 27TH FEBRUARY,2013 SPECIFICALLY MENTIONED”AS SINCE THE PROCEEDINGS ARE LAST ONE AND HALFYEAR,WE DEEM IT PROPER TO TRANSFER THE PETITION PAPERS TO DELHI HIGH COURT AND REQUEST THE LEARNED HIGH COURT CHIEF JUSTICE TO ASSIGN THE WRIT PETITION BEFORE A BENCH OF HIS CHOICE FOR EARLY DISPOSAL OF THE MATTER AT ANY RATE WITHIN THE OUTER LIMIT OF SIX MONTHS FROM THE RECEIPT OFTHE RECORDS.”
  • HOWEVER, NOW THE DELHI HIGH COURT HAS NOT DECIDED THE CASE WITHIN ABOUT 5.75 YEARS DUE TO CHANGES OF OUR PENSION RULES TWICE I.E FROM RULES 1955 TO REGULATIONS 2014 AND RECENTLY AMENDED REGULATIONS 2014 TO AMENDED REGULATIONS 2017 AND SECOND REASON IS FREQUENT CHANGES OF SITTING JUDGESOF DELHI HIGH COURT.

The two amendents of 2014 and 2017, joint note/ Gazette notification etc.are null and void.Any amendment to Regulation act should be in the form bill passed by 2/3 majority of Parliament and that too for the betterment of pension payment and not to reduce pension such as 40/50% formula.The executive orders by GOI/Bank are nothing but a waste papers.

FRIENDS ,OUR W.P(C)1875/2013 AT DELHI HIGH COURT WAS FILED ON 11.03.2011 IN THE FIRST INSTANCE AT THE SUPREME COURT AS W.P(C)184/2011 AND ON TRANSFER TO DELHI HIGH COURT ON 27.02.2013 IT BECAME W.P(C)1875/2013 AT DELHI HIGH COURT THUS, VERTUALLY THIS WRIT IS PENDING FOR THE LAST ABOUT 7.5 YEARS .
    THE MAIN GIST OF THIS WRIT IS THAT ALL THE PENSIONERS OF S.B.I SHOULD GET 50% AS PENSION OF THE LAST 12 MONTHS AVERAGE PAY WITH 30 YEARS PENSIONABLE SERVICE.OUR PENSIONERS FEDERATION DEMAND THAT PENSION SHOULD BE PAID ON THE BASIS OF REGULATIONS 23(1) AND QUASHING THE REGULATION 23(2) WHICH CREAT THE FOMULA OF 50%/40% AND THERE SHOULD BE ONE FORMULA OF 50% PENSION TO ALL RETIREES OF S.B I.

PROCRASTINATE MEANS TO KEEP DELAYING THAT MUST BE DONE.THE POSITION OF PENSION FUND IN S.B.I INDICATE THAT IT IS QUITE SOUND AND IN A POSITION TO TAKE CARE OF THE RETIREES DEMANDS OF 50% AS PENSION OF THE LAST DRWN PAY,100% D.A NEUTRALISATION TO PRE 2002 RETIREES,IMPROVEMENT IN FAMILY PENSION.EVEN THEN OUR PENSION ISSUES ARE PENDING FOR LAST TWO DECADES.

FREQUENTLY ADJOURNMENTS SOUGHT BY RESPONDENTS/PETITIONERS UPSETTING THE SCHEDULE OF WORK..THE RESPONSIBILITIES TO COMPLY WITH IN SITUATIONS OF DELAY.OUR RESPONDENTS ARE STRONG IN THIS COURT CASE ARE UNION OF INDIA,STATE BANK OF INDIA AND RESERVE BANK OF INDIA AND THEY MANAGE T0ONLINGER ON THE CASE.LAWYERS INDULGE IN LENGTHY ARGUMENTS BEFORE THE COURT.THERE IS NEED TO REDUCE THE QUANTUM OF ORAL ARGUMENTS PREPARED WITH GREAT CAUTION AND PRECISION. IT HAS BEEN OBSERVED THAT ORAL ARGUMENTS DIFFER WITH THE ACTUAL PROCEEDINGS LOADED ON THE WEB SITE OF DELHI HIGH COURT AND THE ACTUAL PROCEEDINGS ARE RELIABLE AND WE SHOULD GIVE THE PREFERENCE /IMPORTANCE TO THE ACTUAL PROCEEDINGS.
    SOMETIMES DUE TO FREQUENT CHANGE OF BENCH BY THE COURT AND EACH BENCH STARTS TO HEAR THE CASE A FRESH.THESE ARE THE SOME CAUSES OF DELAY IN THE VERDICT OF THE ABOVE NOTED COURT CASE.

AS ALL OF YOU ARE AWARE THAT”PENSION SCHEME” IN STATE BANK OF INDIA IS GOVERNED BY”STATE BANK OF INDIA EMPLOYEES’PENSION FUND RULES-1955”HOWEVER ,NOW PENSION SCHEME IN STATE BANKOF INDIA IS GOVERNED BY”STATE BANK OF INDIA EMPLOYEES PENSION FUND REGULATIONS-2014”THESE NEW REGULATIONS WERE NOTIFIED ON 18.09.2014.RECENTLY NOW REGULATIONS 2014 HAS BEEN AMENDED IN 2017AFTER REVISION OF PENSION OF 5TH,6TH,AND 7TH BIPARTITE RETIREES AS PER COMMITTEE’S REPORT FORMED BY GOVERNMENT DURING THE HEARING OF THIS COURT CASE ON10.02.2016 , COMMITTEE’S REPORT WAS SUBMITTED ON 24.10.2016 AND ARREARS WERE PAID IN 2017.NOW WE ARE GOVERNED BY THESE AMENDED REGULATIONS 2017 .THUS OUR WRIT PETITION OF THIS COURT CASE HAS BEEN CHANGED TWICE AS I HAVE EALIER SAID.

OUR PENSION ISSUES REMAIN UNRESOLVED DUE TO THE ADAMANT STAND BEING ADOPTED BY THE GOVERNMENT.OUR PENSIONERS FEDERATION HAS BEEN MAKING ITS APEAL TO THE GOVERNMENT FOR RESOLVING OUR PENSION ISSUES.A DUTY IS THEREFORE CAST ON THE OFFICIALS CONCERNED AT THE MINISTRY OF FINANCE OF THE GOVERNMENT AS ALSO THE OFFICIALS OF OUR BANK TO HAVE FRESH AND UNBIASED LOOK INTO OUR PENSION ISSUES WITHOUT ANY LOSS OF TIME.

  8. Dear Sir, Thanks for the update which leads us to infer the matter having gone to the dustbin. We have to stop thinking about this matter and keep shut. Courts have little interest and the SBI also is not serious. So, why hope and get tense ? Regards, Kapil Sopory
