COUNSEL FOR THE PARTIES HAVE OBTAINED INSTRUCTIONS AND STATE THAT THEY HAVE NO OBJECTION TO THIS BENCH HEARING THE WRIT PETITION.
IT IS NOT POSSIBLE TO TAKE UP THE MATTER FOR HEARING TODAY AS 13TH SEPTEMBER,2016 WAS DECLARED HOLIDAY AND THE MATTERS RELATING TO 13TH SEPTEMBER,2016 ARE ALSO LISTED TODAY.

The above is the message from  K R Saini about the development of the pension issue pending with Delhi High Court. Whatever could be the reasons, justifiable or otherwise, but the visible position on the surface is that the case used to be deferred abnormally in the past and is lurking on the same lines even after a new bench was formed. This is for the information of the retirees/pensioners. The readers have no option but to wait, I don’t say till eternity.

  1. Instead of filing a simple WP and against the Bank only,the penfed filed 900+ pages WP,including in it all kind of nonsenses and complicated the simple issue,and unnecessarily naming Tom,dick,and Harry as respondents.
    In the circumstances what else can happen to case #1875/2013?It is not going to see the light of the day,unless,the fedaration leadership and counsels of penfed are changed.

  2. Respected Sir,

    My elder brother Late S.N.Lengure died on 25/07/2013 was an employee of SBI working at Etapalli branch,Distt-Gadchiroli,under Chandrapur Region,Nagpur.
    We applied for Death benefits and thanks to the SBI authorities for all the benefits paid by the end of THREE YEARS from date of death except Lump sum Ex-gratia claim in lieu of Compensation appointment to dependent.
    We applied for job on compensatory ground in the name of my nephew Sandip S Lengure but refused by authorities.
    We initially submitted all claim forms,then again submitted at pension time and again recently we called for submission of the forms and accordingly we have resubmitted it to branch office but we are unknown of the latest status.
    May we get ex-gratia claim or job?
    May we get justice in the matter?
    Please advise.

  3. We should disconnect ourselves from monitoring this 1857/2013 as its a kind of “fix” match among PenFed, Bank & UOI, it has nothing to offer even if finally verdict is delivered on expected lines.
    Lets now focus on CWP 8095/2016 which has been admitted by Delhi HC and its first hearing to take place on 8th Nov, 16.This writ covers 4 issues viz 1.50% Pension min without ceiling, 2.DA at Qtly intervals 3.Updation 4 Family Pension 30% min

  4. RESPECTED SIR, YOU ARE 100% CORRECT. LET US CALL FOR A STATEMENT OF MONEY SPENT FOR THE CONDUCT OF THIS CASE. ALSO ENQUIRE INTO THE ASSETS OF THE LEADERS FOR THE YEARS 2013-14 TO 2016-17. THAT WILL BRING OUT THE REAL BENEFACTORS.

  6. Dear sir, We observe the developments in the case of updation of pension. It seems that it gains galloping speed. New cases are being admitted in Supreme court by petitioners on behalf of nationalized banks. On behalf of SBI pensioners, a case is filed in individual capacity by Shri Umesh Sharma at DHC in front of the same judges at the same court where sbi pen fed case is going on.
    Date of next hearing is also the same i.e. on 8/11/2016,
    Regarding LIC, they have also stepped in legal forums and their cases are also travelling. But a ray of light is seen- they have been awarded an interim relief order of 40%-On reading that in our mind, we feel happy as if we had got the interim relief visualizing the favorable orders for sbi pensioners.
    In RBI, they have resorted to Dharna, picketing and representing to RBI Governor.
    Updation of pension not only be a problem prevailing in Financial sectors. Defence pensioners also vociferously raise their demand of One rank one pension revealing the truth that elder pensioners receive less than the younger pensioners.
    But central govt employees and state govt employees are being relieved of these issue till now. But we do not know how long?
    All these general trend make me to ask one question why? Some say due to some individual? May be due to the lack of interest? lack of dedication? lack of direction? lack of involvement?
    But honestly asking that is this the reason for all in the financial sector/defence dept?
    We have to go deep and see who is behind the rope on the other end pulling us down?
    It is obvious we could not so far win our cause.
    In our team, some may not put their full energy/force; some may play foul; some may leave the rope: some may pretend to pull it to win;
    In the past, we have seen so many negotiations; we have scars of stabbing on our back; yes it happens almost in every wing of labour units;
    The force behind this, the force which indulges in the foul game- which has inherited these type of Attitude from the British – the powers that ruled us-ruling us- whoever be at the helm of affairs.
    we have to strengthen us-unite all in financial sectors-joint coordination may add weight behind us.
    At the same time, individual cases may be proceeded with the confidence of winning with pin point legal arguments and with the most efficient counsels.
    On reading Nakara case judgments, we are immensely impressed what a great judgment- a judgment which has analysed thoroughly every angle/studied so deeply the issue- and becoming a holy book on legal aspects.
    The excerpts of it answer every question we have in our mind. A guidance to many cases.
    We salute all persons behind the judgment. We imagine how much efforts they have put; how long they have proceeded in order to find out the leading text.
    Just filling a petition seem to be a Himalayan task -with so many lapses, by our own admission, even after clear guidance from seniors make us worry- whether it can lead us in our journey to justice-
    we have started the journey- it may be short- but our experience shows that the sky appears to be very near;
    Let us have in mind that all victory has not come just like that.
    With that determination, we should compose ourself and go ahead;
