An ocean of guidelines, advices, clarifications and explanations in relation to anomalies in pension issues has already been amply provided by K R Saini followed at a stage by H Ganapathy to the readers of this blog being pensioners, retirees and will wishers but the area is enormously giant sized and there is no calling it a day as there are lot of people seeking some opinion or the other every day. Picked up as it is from the comment made by K R Saini himself on a relative post on this blog, the same is reproduced below for their clarification and knowledge:

MAXIMUM DRAWN REVISED PAY( 111.1987)WITH EFFECT FROM DATE OF RETIREMENT,OUR PENSION WAS CURTAILED RANGING FROM 31.7% TO 16.22% OF THE LAST DRAWN PAY.
FROM1.03.1999 ONWARDS,DISCREMINATION WAS CAUSED AMONG THE SBI PENSIONERS BY DIVIDING THEM IN TO TWO CLASSES-ONE CONSISTING OF ABOUT 80% OF PENSIONERS RETIRED AS AWARD STAFF AND OFFICERS INJUNIOR MANAGEMENT CADRES ELIGIBLE MAXIMUM PENSION AT50% OF THEIR SALARY AND OTHER CLASS CONSISTING OF ABOUT20% OF PENSIONERS RETIRED AS OFFICERS IN SCALE II AND SENIOR AND TOP MANAGEMENT CADRE ELIGIBLE FOR MAXIMUM PENSION ONLY AT40% OF THEIR PAY.
IN PARTICULAR,THE MAXIMUM DEPRIVATION HAS BEEN CAUSED TO ALL PENSIONERS RETIRED FROM 1.11.1997(AWARD STAFF)1.04.1998(OFFICERS) TO31.10.2002 DRAWING PAY SCALES AS PER 7TH BIPARTITE PAYSCALES BUT BOTH AWARD STAFF ANDOFFICERS PAYMENT OF PENSION ONTHE PRE-REVISED SCALES OF 6TH BIPARTITE PAYSCALES.
THE REGULATION23(1) OF OURPENSION FUND REGULATIONS STIPULATING THE COMPUTATION O F OUR PENSION ON OUR LAST DRAWN SALARY HAS BEEN IGNORED.THERE CANNOT BE JUSTIFICATION FOR NOT PAYING THE7TH BIPARTITE PENSIONERS ON PAR WITH THE PENSIONERS OF 6TH,8TH,9TH AND NOW 10TH BIPARTITE PERIODS BYCOMPUTING THEIR PENSION ON THE BASIS OF SAME FORMULA ADOPTED FOR THEM.THERE COULD BE NO RATIONAL AS TO WHY THE BASIC PENSION OF THE PENSIONERS RETIRED DRAWING 7TH BIPARTITE PAY SCALES WAS NOT COMPUTED ON THEIR LAST DRAWN PAY,WHEN THEIR FAMILY PENSION WAS REVISED AND COMPUTED ON THEIR 7TH BIPARTITE PAY SCALES
THE PENSION SCHEME OF STATE BANK OF INDIA SHOULD BE PROVIDED FOR THE PAYMENT OF THE PENSION TO ITS EMPLOYEES AT 50% OF MONTHLY AVERAGE SALARY FR A MAXIMUM PENSIONABLE SERVICE OF 30 YEARS AND FOR THAT OUR PENSIOERS FEDERATION HAS FILED A WRIT PETITION AND OUR COURTCASE NO W.P(CIVIL) 1875/2013 IS PENDING AT DELHI HIGH COURT.

    THE CEILING OF MONTHLYPENSION IN RESPECT OF EMPLOYEES RETIRED 1.11.1987 TO 31.101992 ARE NOT ALGINED TO THEIR LAST DRAWN SALARY AS PER 5TH BIPARTITE SETTLEMENT,THIS SHOULD BEREVISED FROMRS2400/P.M TO RS3775/P.M(50% OF THE SALARY OF HIGHEST SCALEDURING 5TH BIPARTITE.)
    (2)REVISION IN PENSION CEILING NOT COINCIDING WITH THE DATE SALARY REVISION. (A)
    6TH BIPARTITE SETTLEMENT(1.11.1992 TO31.10.1997)—ALTHOUGH 6TH BIPARTITE SETTLEENT WAS MADE EFFECTIVE FROM 1.11.1992,THE PENSION CEILING WAS REVISED TO RS4250/ W.E.F 1.11.1993.THECEILING OF6TH BIPARTITE RETIREES OF THE PERIOD 1.11.1992 TO31.10.1993 HAS REMAINED AT RS2400/PER MONTH AS PENSIONI.I.ETHEYARE DRAWING PENSION LESSER THAN50% WHICH SHOULD HAVE BEEN RS4250/P.M.AS SUCH PENSION CEILING IN RESPECT OF RETIREES PERTAINS TO THE PERIOD 1.11.1992 TO31.10.1993 IS REQUIRED TO BE REVISED.

    8TH BIPARTITE SETTOEMENT(1.11.2002 TO31.10.2007) EFFECTIVE W.E.F 1.11.2002,THE PENSION CEILING WAS REVISED W.E.F 1.05.2005.THE CEILING OF 8THBIPARTITE RETIREES OFTHEPERIOD 1.11.2002 TO 30.04.2005 IS REQUIRED TO BE INCREASED TO THEIR LAST DRAWN SALARY AND COMPUTED ON THE BASIS OFAVERAGE OF THELAST 12 MONTHS SO AS ON THE BENEFIT OFREVISED PENSION CEILING WHICH CAME INTO EFFECT FROM 1.05.2005.
    KINDLY NOTE I WILL COMMENT ON 7TH ,9TH AND10TH BIPARTITE RETIREES SEPARATELY.

    IN TERMS OF 23(1) OF STATE BANK OF INDIA EMPLOYEES PENSION FUND RULES -1955 AND NOW REGULATION 23(1) OF STATE BANKOF INDIA EMPLOYEES PENSION FUND REGULATIONS -2014,THE PENSION PAYABLE SHALL BE THE AMOUNT CALCULATED AT THE RATE OF ONE-SIXTIETH OF EVERY YEAR’S PENSIONABLE SERVICE OF THE AVERAGE MONTHLY SALARY SUBSTANTIVE SALARY DRAWN DURING THE LAST 12 MONTHS PENSIONABLE SERVICE . DESPITE THIS RULE.REGULATION AND THIS FORMULA IS STATUTORY IN NATURE FROM 1.1.1986,HOWEVER THIS FORMULA IS DIFFERENT FORTHEV7TH BIPARTITE RETIREES.IN S.B.I PENSION ISTO BECALCULATED ON THEVAVERAGE MONTHLYNSUBSTANTIVE SALARY DRAWN DURING THELAST12 MONTHS PENSIONABLEBSERVICE AND THIS HOLDS TRUE FOR ALL THE PENSIONERS INS.B.I EXCEPT FOR THE 7THNBIPARTITERETIREES WHERE FOR THE PURPOSE OF CALCULATION OF PENSION,PAY SCALES AS PER 6TH BIPARTITE SETTLEMENT ARE TAKEN INTO ACCOUNT,BUT THEY WERE DRAWING SALARY INTHE PAY ACALES OF7TH BIPARTITE SETTLEMENT AT THE TIME OF THEIR RETIREMENT(S).AS A RESULT OF THISMAXIMUM BASIC PENSION OF 7TH BIPARTITE RETIREE IS 24.09% OFTHE PAY AT THETIME OFHIS RETIREMENT.DEPUTY MANAGING DIRECTOR WHO RETIRED IN THE 7TH BIPARTITESETTLEMENT WAS DRAWN AVERAGE PAY OF RS23700/PER MONTH BUT HIS ISDRAWING BASIC PENSION OFRS5920/ PER MONTH WHICH COMES TO 24.9% OF RS23700/.THUS GRAVE INJUSTICE HAS BEEN DONE TO 7TH BIPARTITE RETIREES.M.O.F SHOULD REVISE THE PENSION OF7TH BIPARTITE RETIREES IMMEDIATELY.

  3. 9TH BIPARTITE SETTLEMENT FROM 1.11.2007 TO 31.10.2012.THIS SETTLEMENT IS EFFECTIVE FROM 1.11.2007 AND PENSION IS PAYABLE WITH EFFECT FROM1.11.2007 ON THE FORMULA OF50%4% I.E UPTO SALARYOF RS31500/AT THE RATEOF50%MINIMUM RS15750/PER MONTH AND ABOVE SALARYOF 31500/ ATTHE RATE OF40% OFTHE SALARY.

  4. 10TH BIPARTITE SETTLEMENT FROM 1.11.2012TO 31.10.2017.PENSION ON THEBASIS OF10TH BIPARTITE SETTLEMENT WILL STARTS FROM111.2012 AS PER PENSION RULES /PENSION REGULATIONS IN FORCE.THIS MEANSTHESE RETIREES WILL ALSO GET PENSION ON THE FORMULA OF50%/40% AS IN THE CASE OF8TH AND 9TH BIPARTITE RETIREES.THUS I HAVE EXPLAINED THE PENSION POSITION FROM1.11.1987 TO AS ON DATE.(FROM5TH BIPARTITE TO10TH BIPARTITE.)

  5. 50% OF THE LAST DRAWN AVERAGE PAY OF LAST 12 MONTHS WITHOUT ANY CEILING.THE SALIENT POINTS ARE MENTIONED BELOW FOR THE INFORMATION OF ALL PENSIONERS.
    THE SUPREME COURT VIDE ITS JUDGEMENT INCASE OF 307 OF 1987 RULED AGAINST TWO SEPARATE CEILINGS ON PENSION FOR OFFICERS AND WORKMEN STAFF EVEN THOUGH FOR BOTH OF THEM THE PENSION WAS PAYABLE AT 50% OF THE LAST BASIC PAY AT THAT POINT OF TIME.THE SUPREME COURT GAVE THE RULING ON 23.02.1989.DURING THE COURSE OFHEARING OF THE PETITION IN THE SUPREME COURT.THE BANK IN CONSULTATION WITH G.O.I PRESENTED A PROPOSAL FOR REVISION BEFORE THE COURT..THE COURT HELD THAT ONCE ITIS REALISED THAT PENSION IS A RIGHT AND NOT A BOUNTY,IT WOULD NOT BE PROPER TOLEAVE THE QUANTUM OFPENSION AT THE DISCRETION OFTHE TRUSTEES IN EACHCASE.THE COURTFIXED THE OUTER CEILING OF PENSION TO BE RS 2400/ PER MONTH.AT THEMATERIAL TIME,THIS OUTER CEILING OF RS2400/ WAS 50% OF THE AVERAGE SUBSTANTIVE SALARY DRAWN BY AN OFFICER OF THE RANK OF DEPUTY MANAGING DIRECTOR.THE COURT ALSO APPRECIATED THE FACT THAT THE BANK AUTTHORITIES HAD WORKED OUT THE REVISED SCHEME KEEPING IN MIND THE RECOMMENDATIONS OF 4TH PAY COMMISSION FOR CENTRALGOVERFNMENT EMPLOYEES.FOR CENTRAL GOVERNMENT EMPLOYEES,THE PROVISION WAS MORE OR LESS IDENTICAL VIZ-,50% OF THE AVERAGE SUBSTANTIVE SALARY NOT EXCEEDING RS 4500/PER MENSEM,(VIDE CHATER V,PART II,OFTHE COMMISSION’S REPORT).
    SUBSEQUENTLY,DURING 5TH BIPARTITE SETTLEMENT (1.11.1987 TO31,10.1992) THERE WAS NO REVISION CONSIDERED IN THE PENSION CEILING AND SINCE THEN,THERE HAS BEEN AN ISSUE ONTHE PENSION CEILING.AND OUR PENSIONERS FEDERATION IS FIGHTING FOR THIS ISSUEINTHE HIGH COURT AND W,P(CIVIL)1875/2013IS PENDING ATDELHI HIGHCOURT.
