A LOT HAS BEEN SAID IN JUST A FEW WORDS REVEALING THE REAL PICTURE IN RELATION TO JUDICIARY IN INDIA, HENCE THIS REBLOGGING..

The Court and the Cutchery

31.1 million cases pending.

4,706 positions vacant.

An average of 6-9% annual rise in workload.

Yes, this is what the Indian judiciary is staring at.

Against the backdrop of increasing violence against women, communal clashes, terrorism and a thousand other factors, the above figures present the grim situation of our country’s Justice System. And the recent controversies surrounding the famous actor turned infamous driver Salman Khan, Satyam scam accused Ramlingam brothers, Masarat “Meri jaan, Pakistan” Alam, several Gujrati cops accused of fake encounters and last but not the least our dear own Amma, have only added fuel to the fire.

For the uninitiated, the only common factor between these random people from different parts of the country are–

Firsly, they all have been granted relief by our courts.

Secondly, they all have been accused of serious misdeeds.

So what happened to the Judges? Why are they not banging their wooden…

We borrowed the judicial system from the British as they ruled the country for over 200 years.The system is unsuited to our country>it is high time we revamp our systed to ensure time bound justice delivery system.As is seen our judiciai system favours vexatious litigation and helps litigants who wish to delay.A time cap of one year for every case has to be fixed and justice delivered.What is the use of a system where judgement is delivered after the death of the petitioner.Our lawyer brotheren and disgruntled litigants are taking the judiciary for a ride,In no case can adjournments can be granted unless it it for exigencies like death or such serious reasons.Our courts gant adjournments at the fall of a hat.A judicial commission should oversee the judicial system to prevent abuse of the court procedure.The rich who have enough money play with the system by submitting hupteen petitions which calls for noyice to all parties and filing of written submissions., therby preventing the courts from delivering justice in time.The Govt is also to blame for filing appeals to delay the justice. instead of avoiding vexatios litigation.The Banks Pensioners cases pending in various courts is a pointer.

THE PROBLEM OF DELAY AND ACCUMULATION OF HUGE ARREARS OF COURT CASES BOTH IN HIGH COURTS AND SUPREME COURT HAVE ASSUMED SERIOUS DIMENSIONS AND LOT OF SERIOUS DIMENSIONS AND LOT OF CRITICISM OF THE ENTIRE LEGAL SYSTEM.THE CAUSE OF DELAY ARE MANY. THERE ARE LUCANAS WITH THE LAW ITSELF OF WHICH CLEVER LAWERS SEEK ADJOURNMENTS ON PERSONAL GROUNDS,FOR THE BENEFIT OF THEIR CLIENTS.SHRI NEELKANTH JI HAS WRITTEN A POST”JUSTICE DELAYS JUSTICE DENIED.”KINDLY GO THROUGH THAT POST WITH COMMENTS.THE LAWS IN LEGAL SYSTEM GIVE RISE TO UNLIMITED SUITS,THE PURPOSE BEING NOT TO SEEK REDRESS BUT,CAUSE THE HARASSMENT TO OPPONENTS/PETITIONERS.THE GOVERNMENT/BANK IS ALSO TO BLAME FOR FILING APPEALS IN THE HIGHER COURTS TO DELAY THE JUSTICE,INSTEAD OF AVOIDING VEXATIOS LITIGATION.

WE ARE LIVING IN A SOCIETY WHERE INSTANCES ARE THERE WHICH EVEN DIFFERENT HIGH COURTS VERDICTS ARE NOT IMPLEMENTED BY THE GOVERNMENT/STATE BANK OF INDIA MANAGEMENT.SO ALSO IN CASES DECIDED IN FAVOUR OF 7TH BIPARTITE RETIREES BY THE MADRAS HIGH COURT,KERALA HIGH COURT,CALCUTTA HIGH COURT AND NOW DELHI HIGH COURT IN THE YEAR 2008,2010,2012 AND 2015 RESPECTIVELLY.STATE BANK MANAGEMENT UNDER THE ADVICE OF M.O.F/GOVERNMENT OF INDIA PREFERRED APPEALS AGAINST THE JUDGEMENTS JUST TO DENY THE BENEFITS TO S.B.I PENSIONERS.
    AS ALL OF YOU AWARE OUR PENSION RULES ARE STATUTORY IN CHARACTER ,EVEN THEN STATE BANK CANNOT APPLY THESE STATUTORY RULES WITHOUT THE PRIOR APPROVAL OF GOVERNMENT OF INDIA FROM TIME TO TIME.
    OUR PENSIONERS FEDERTATION W.P(CIVIL) 1875/2013 IS PENDING AT DELHI HIGH COURT.THIS WRIT PETITION VIRTULLY FILED IN 2000 BY THE PENSIONERS’ FEDERATION IN THE SUPREME COURT AS W.P(CIVIL)529/2000 FOR REDRESSAL OF PENSIONERS’GRIEVANCES AND LATER ON W.P(CIVIL) 529/2013 WAS WITHDRAWN FROM THE SUPREME COURT ON 16.10.2000 ON THE ADVICE OF THE SUPREME COURT THAT OUR PENSIONERS’ FEDERATION SHOULD FIRSTFILE THECOURT CASE IN A HIGH COURT THEN OUR PENSIONERS FEDERATION FILED A COURT CASE IN 2002THROUGH 6 PENSIONERS AND 1 FAMILY PENSIONERS WHO WERE RETIRED BEFORE1.11.1993 FOR SOLUTIONS OF PENSIONERS’ ISSUES AND IMPROVEMENT IN FAMILY PENSION.THIS COURT CASE IS REGARDING PREM VATI BAGGA AND OTHERS W.P (CIVIL) 1931/2002 AND IS STILL PENDING BEFOREA SINGLEVJUDGE AND NEXT DATE OF HEARING IS16.07.2015.
    WE HAVE THE HISTORY AND THE FACTS BEFORE US , HOW JUSTICE IS PREVAILING IN INDIA.AS SUCH THERE IS NO POINT TO BLAME OF UNIONS OR STATE BANKOF INDIA management at this juncture.
    UNLESS PRESURE IS BUILT ON GOVERNMENT OF INDIA/M.O.F ,PENSION ISSUES IN SBI WILL NOT BE RESOLVED.OUR PENSIONERS’ FEDERATION IS FIGHTING IN THIS DIRECTION BY USING ALL THE POSSIBLE METHODS AND MET IN PERSON THE STATE FINANCE MINISTER ON THE 10TH JUNE,2015AND GAVE A REPRESETATION ON ALL THE PENSION ISSUES INS.B.I.LET US HOPE FOR THE BEST.

  4. JUDICIAL AND LEGAL MACHINERY DO NOT WORK IN ISOLATION FROM SOCIETY. THEY ARE INTEGRAL PARTS OF ENTIRE SOCIAL AND POLITICAL SYSTEM.THEIR WORKING DEPENDS ON THE CO-OPERATION OF OTHER ELEMENTS.WE MUST HAVE NON POLITICAL,EFFICIENT,DEDICATED HONEST AND UPRIGHT JUDICIARY WHICH MUST HAVE ITS RESPONSIBILITY AND REMAIN FEARLESS, ONLY SUCH PERSONS SHOULD BE APPOINTED AS JUDGES WHO ENJOY THE CONFIDENCE OF GIVING THE RIGHT JUDGEMENTS .THEY MUST BE ALLOWED TO FUNCTION IN SUCH A MANNER THAT THE COUNTRY IS ASSURED OF FAIR AND EQUAL JUSTICE ALONGWITH SOCIAL AND ECONOMIC JUSTICE.

  5. What I find distressing is people who still praise Salman Khan when clearly he has no respect for human life other than his own. My way to protest, is NEVER to see a movie that he stars in again because clearly, the judicial system is not working equally for everyone.
