Methodology of any discipline is always subject to a change in consonance with the passage of time coupled with the cycle of events. One of the experts on pension issues in SBI KR Saini expressed his concern on the pension issue not eliciting the desired outcome even after hectic efforts made by all concerned. What should be done was his question to me. This is a genuine anxiety where we along with our readers, pensioners and the other sympathizers have to work out the requisite strategies away from a rotten conservatism with a pragmatic mind. I applied my mind to the task with repeats but nothing has emerged as a key note but what I strongly feel is that the very pensioners themselves may have to be there in the forefront and a lot has since been done for generating necessary awareness amongst them. I also feel that an aggressive system may have to be evolved to further generate necessary confidence in the matter of life itself on which the retirees are well known for feeling always shaky. Let us not forget that what the current generation is doing is not for themselves alone, more than that what they do today is more for the posterities. This is just a vague thought and it is for the readers to receive it the way it suits them. I am sharing this part of the problems with the readers to themselves give a thought to this and share their views with us. The more the opinions and suggestions are received from them the more are the chances to rebuild the via media with a bigger strength capable of securing a powerful tool to overcome the tasks related to the workforce both past and present.

  1. I think that the first time I replied to a post on this issue. I was of the opinion that it was going to be an uphill climb to reach a successful conclusion for the pensioners.   2. ppraise him of the wrong done to the pensioners by the previous finance minister and also appraise him of the tactics of the banks and the IBA by appealing against judgements of courts despite the policy of the govt to avoid vexatitious litigation,wasting public money.The new theory floated by the Iba that on retirement contrract of emlyoment ceases and pensioners are left adrift is some crude thinking that has to be nipped in the bud.Only political pressure can rid the powers of this type of muddled thinking.

The only course left to the Pensioners is to demonstrate and petitioning.Already our leaders are at it.The only course now open is to meet our honourable Prime Miniser and appraise of the wrong done to the pensioners by the previous finance minister and his department and also apprraise him of the tactics of the banks and the IBA in appealing against High courts judgements to frustrate the pensioners, inspite of the policy of the govt to avoid vexatious litigation wasting public money.The new theory floated by the IBA in its recent note on conclusion of the 10thBipartite talks that the contract of employment ceases on retirement.This type of crude thinking which runs contra to the pronounced judgement of the SC that pension paid is adeffered wage and is not a bounty.This thinking of the Iba has to benipped in the bud.

OUR PENSION ISSUES REMAIN UNRESOLVED DEUE TO ADAMANT STAND BEING ADOPTED BY THE GOVERNMENT.THE PRESENT PRECEPTION OF THE OFFICIALS OF THE FINANCE MINISTRY NEEDS TO BE CHANGED.THE PRECEPION ENTERTAINEDS BY THEW VARIOUS OFFICIALS DEALING OUE PENSION ISSUES 0OVER THE YEARS IS UNFORTUNATELY PASSED ON TO THEIR SUCCESSORS.WE ARE NOT SURE WHETHER5 OUR BANK HAS MADE ADEQUATE AND PERSISTENT EFFORTS WITH SUITABLE explanation for changing this prejudiced perception .OUR federation has been making ITS APPEAL TO THE GOVERNMENT and reviewing its adamant stand .NO decision of the government and its machineries SHOULD result in the violation of the fundamental rights of a large section of senior citizens.

WE NEED TO EXPRESS OUR ANXIETY ON THE LACK OF CONCERN ON THE PART OF OURBANK AND THE SERVING FEDERATIONS FOR NOT TAKING UP OUR PENSION ISSUES ADEQUATELY,APPROPRIATELY AND PERSISTENTLY WITH THE GOVERNMENT BY MAKING A STRONG JUSTIFICATION FOR RESOLVING THEM WITHOUT FURTHER LOSS OF ANY TIME.THE OTHER BANKS HAVE RESOLVED THE LONG PENDING PENSION ISSUE OF PROVIDING ONE MORE OPTION TO THEIR EMPLOYEES IN TH 9TH BIPARTITE SETTLEMENT AND THEY HAVE ALSO SOLVED THE PNSION ON 7TH BIPARTITE PAY SCALES W.E.F 1.05.2005INTHE 8TH BIPARTITE SETTLEMENT. THIS IS THE RIGHT OPPORTUNITY TO FIND DURABLE SOLUTIONS TO ALL PENSION ISSUES.WE TRUST ALL CONCERNED WOULD DISPLAY SUFFICIENT WISDOM AN D UTILIZE THEIR RICH EXPERIENCE IN FINDING JUST AND IMMEDIATE SOLUTIONS TO OUR PENSION ISSUES.

THE REVISION 0OF OUR PENSION ON 7TH BIPARTITE PAY SCALES AND PAMENT OF PENSION AT 50% OF LAST DRAWN AVERAGE PAY ARE SOME OF OUR PENDING PENSION ISSUES.FOR RESOLVING THESE TWO ISSUES,A SUM OF RS 200 CRORES P.A WILL ONLY REQUIRED TO BE MADE AVAILABLE FROM THE PENSION FUND.MY ESTIMATE IS THIS TIME STATE BANK WILL GET ABOUT 900 CRORES.OUT OF THE AMOUNT OF RS900 CRORES AVAILABLE TO OUR BANK AS THE SHARE OF INCREASE IN THE ESTABLISHMENT EXPENSES PERMITTED TO BE INCURRED BY OTHER BANKS,A SUM OF RS200 CRORES COULD BE VERY WELL E ARMARKED FOR GIVING RELIEF TO ALL AGED PENSIONERS OF STATE BANK OF INDIA .THIS TIME ACCORDING TO CLUSE 39 OF 10TH BIPARTITE STATE BANK OF INDIA PROVIDED A SPECIAL COMPENSATORY ALLOWANCE. .FOR THIS REASON FULL CO-OPEWRATION OF SERVING FEDERATIONS ARE REQUIRED BECAUSE THEY WILL TRY TO TAKE THIS SPECIAL, COMPENSATORY ALLOWANCE MAXIMUM.

Is it not a disgrace on d part of State Bank of India Pensioners Associations(all circles) and its Federation to say that they couldnot do anything to findout a solution on d pension computation ( on d baisis of last drawn salay.)of d sbi’s 7thbypartite retirees ,whereas other Bank Retirees’Associations were able to squareup d issuie longback.What is d reason / purpose of such a delay.Really Our Leaders are fully responsible for drawing d issuie without finding a solution since 2002.At present d GOI/ MOF /BANK authorities divisioned d pensioners into small fragments which never mentaly joined for a common cause.

    THE ISSUE OF PENSION REVISION OF 7TH BIPARTITE RETIREES IS QUITE GENUINE,THE 7TH BIPARTITE RETIREES COMPRISE THOSE WHO RETIRED DRAWING SALARY AS PER 7TH BIPARTITE WAGE SETTLEMENT(PERIOD BETWEEN1.11.1997(AWARD)/1.04.98(SUPERVISING STAFF)TO 31.10.2002).AN INJUSTICE HAS BEEN DONE TO THEM,THE POSION IS EXPLAINED HEREUNDER;
    THE 6TH BIPARTITE SETTLEMENT ARRIVED AT IN 1995 WAS IMPLEMENTED FROM 1.11.1992/1.7.1993.AT THIS TIME,PENSION OF THOSE RETIRED WAS RAISED WITH EFFECT FROM 1.11.1993 AND THE CEILING WAS RAISED UPWARDS FROM RS2400/TO RS 4250/ BY ADJUSTMENT OF D.A AND DIFFERENCE BETWEEN 600 POINTS OF CONSUMER PRICE INDEX(CPIN) AND 1148 POINTS.THE REVISION WAS EFFECTED IN PRINCIPLE,ALTHOUGH IN FACT IT DID NOT SIGNIFICANTLY CHANGE THE GROSS PENSION PAYABLE.

THE ABOVE CEILING OF RS 4250/ WAS AGAIN REVISED WITH EFFECT FROM 1.3.1999-THE NEW FORMULA WAS INTRODUCED BY WHICH THOSE GETTING SALARY UPTO RS8500/WOULD GET PENSION AT 50% AND THOSE GETTING ABOVE RS8500/ WOULD GET PENSION AT 40% OF THESALARY SUBJECT TO MINIMUM OF RS4250/.AS CONSEQUENNCE OF THIS,CLERKS AND OFFICERS JMGS1 WOULD GET PENSION AT50% OF THE AVERAGE PAY,WHEREAS OFFICERS MMGS11 ONWARDS RECEIVED PENSION AT40% OF THE LAST DRAWN AVERAGE PAY.

IN THE CASE OF 7TH BIPARTITE SETTLEMENT,WHICH WAS FOR THE PERIOD FROM 1.11.1997(AWARD STAFF)/1.4.1998 (SUPERVISING STAFF)THE SALARY REVISION TOOK PLACE ON 14.12.1999(SUPERVISING STAFF) AND 27.03.2000 (AWARD STAFF) RESPECTIVELY WITH RTROSPECTIVE EFFECT .However, due to oversight a corresponding revision of pension did not take place for these retirees. THEREFORE,ALL TESE 7TH BIPARTITE RETIREES ARE GETTING PENSION ON THE SALARY AS PER PAY SCALES OF 6TH BIPARTITE SETTLEMENT and not on their actual last drawn average pay. IN FACT,FAMILY PENSION,PROVIDENT FUND AND GRATUITY WERE PAID TO THESE RETIREES ON THE VBASIS OF THEIR LAST DRAWN SALARY.THIS IS THE ONLY GROUP OF PENSIONERS IN THE BANK WHICH IS NOT GETTING PENSION ON THEIR ACTUAL DRAWN PAY,WHICH IS INEQUITABLE..

THE COMMITTEE ON PENSION SET UP BYS.B.I ON THE ADVICE OF GOVERNMENT OF INDIA ALSO DILBERATED ON THE ISSUE AND INTRACTED WITHBOTH THEVFEDERATIONS ON THE ISSUE OF REVISION OF PENSION OF7TH BIPARTITE RETIREES. It recommended government of India to consider the issue de-novo. SINCE THIS ISSUE HAS NOT BEEN SETTLED TO THE SATISFACTION OF THE PENSIONERS,IT HAS BECOME A CONTINUING AND RECURRING CAUSE OF FRICTION.

Delaying tactics do not work.Both the Bank and the IBA and the Govt should knoe the views of the Supre court that Pension is a prorperty right.Delaying it settlement will attract interest clause.Even family pensioners aho are receiving the family pension on the death of the pensioner will get the benifit of arrears with interest.Delay costs.Let the powers awake or pay through your nose.

  16. christen the name of the pensioners collective force irrespective of their present affiliation and cadre. Let us enlist the services of senior and knowledgeable lawyer colleagues who can represent us in apex courts. Let us also follow up the letter to PM and simultaneusly arrange for dharnas in as many centres and capable retirees only need participate.and with support of local media. Initially expenses need be met by the local retirees.

The federation has taken one more begging to the finance minister and has written the chairman to utilise the opportunnity created by the BPS and release funds from sbi to meet the demands of 7th bipartite retirees.
