H. Ganapathy commented on A cursory look on Pension in State Bank of India !

The President of All India State Bank Of India Staff Federation informed at a meeting wherein I attended during last month that the serving Federation has already been negotiating with SBI Management to clinch the pension issue related to 7th BP retirees as early as possible, but since the matter is connected with 5th & 6th BP retirees, he added, that it is the utmost endeavour of the serving Federation to clinch the issue related to 5th & 6th BP retirees first and then come up with the 7th BP retirees and in this regard he appreciated the stance taken by the SBI Chairperson, who according to him, required the serving Federation to give her 3 months time to settle the matter with the GOI step by step in favour of the aforesaid retirees.

    IN THIS CONNECTION PLEASE REFER TO SUPREME COURT ORDER DATED 23.02.1989,IN THE WRIT PETITION(CIVIL) 305 OF 1987.THE UNNESARY COMPLICATIONS IN COMPUTATION(CALCULATION) AND PAYMENT OF PENSION IN THE BANK,WHICH LED TO UNMITIGATED FINANCIAL HARDSHIPS TO THEVRETIREES,COULD HAVE BEEN AVERTED HAD THE GOVERNMENMENT/BANK ACTED AS PER DIRECTIVES CONTAINED IN THE SUPREME COURT VERDICT DATED 23.02.1989.THE SUPREME COURT ORDER MENTIONED HAD MADE IT CLEAR THAT THE PENSION RULES DO NOT DISCCRIMINATE WITHIN CLASS.THE INTRODUCTION OF THE DOUBLE PERCENTAGE CEILING DEFIES THE SUPREME COURT ORDER AS IT CREATES A CLASS WITHIN CLASS AND SUGGEST THE BANK THAT CEILING OF PENSION AS ONE-HALF OF THE AVERAGE 12 MONTHS SUBSTANTIVE SALARY IS TO BE INTRODUCED TO ACHIEVE UNIFORMITY WITH THE PENSION PLAN APPLICABLE TO S.B.I EMPLOYEES.

    SEEKING CLARIFICATION ON THE WORD”and thereafter.” WHICH IS USED FOR A COMMON FORMULA FOR 6TH AND 7TH BIPARTITE RETIREES.AS I AM NOT A LEGAL EXPERT AND ACCORDING TO ME THIS WORD HAVE DEEP MEANINGS BECAUSE THIS WORD IS NOT USED FOR 8TH AND 9TH BIPARTITE PENSIONERS SECONDLY THERE IS DOUBT IN MY MIND THAT 7TH BIPARTITE RETIREES ARE NOT DRAWING SCALES OF 6TH BIPARTITE PAYSCALES AT THE TIME OF THEIR RETIREMENT THIS FORMULA IS APPLICABLE W.E.F 1.3.1999 AND THEREAFTER MEAN AFTER 1.3.1999 ALL THE 6TH BIPARTITE RETIREES WILL GET PENSION ON THIS FORMULA NOT 7TH BIPARTITE RETIREESF.THIRD MEANING IS THAT THEREAFTER MEAN SUSEQUENT PAYSCALES OF 7TH BIPARTITE EVEN 8TH BIPARTITE RETIREES AS IN THE CASE OF 8TH BIPARTITE RETIREES PENSION HAS BEEN REVISED ON 1.5.2005 AFTER GENRAL STRIKE IN APRIL,2006 IN S.B.I.KINDLY RESPOND TO THIS WRITE UP FOR MY BCLARIFICATION AS THIS WORD ”thereafter””IS USED ONCE IN THE WHOLE OF REGULATION-2014.

    FACTS REMAIN AS FACTS,AS ,EVERY ONE KNOW THAT PENSION UPDATION HAS NOT BEEN IMPLEMENTED IN BANKING INDUSTRY INCLUDING S.B.I FROM 1955 WHEN THE STATE BANK OF INDIA IS FORMED AFTER NATIONALIZATION OF IMPERIAL BANK OF INDIA.BASIC PENSION OF ANY PENSIONER HAS NOT GONE UP BUT IS ANOTHER FACTOR THAT D.A OF BANK PENSIONERS HAS NOT BEEN REDUCED AT ANY POINT OF TIME SINCE 1986(EXCEPT,ON ACCOUNT OF DECREASE IN CONSUMER POINT INDEX) 2BASIC PENSION AMOUNT ALSO NOT BEEN REDUCED.3 SINCE THE ALL INDIA CONSUMER PRICE INDEX IS INCREASED OF THESE YEARS AND PENSIONERS ARE GETTING HIGHER D.A AS WELL AS HIGHER MONTHLY TOTAL PENSION I.E BASIC PENSION PLUS D.A.
    IT IS ALSO A FACT THAT 100%D.A HAS NOT BEEN IMPLEMENTED TO PRE 1.11.2002 RETIREES SOFAR,AS SUCH THEY ARE DRAWING LESSER D.A COMPARED TO POST 1.11.2002 RETIREES THIS ANOMALY RELATES TO 5TH,6THAND 7TH BIPARTITE RETIREES IN ALL THE BANKS.

  15. dear sir, i am retired under vrs, march 2001 from sbi, after reading the different viwes in depth regarding the sbi pension fund rules,i am able to understand the court case and the demands of sbi pensioners.
