This is the first day of the New Year 2015 and the retiree pensioners from SBI are pinning their hopes expecting that the New Year turns out to be virtually the ‘Happy News Year’ for them eliciting a positive outcome in regard to pension issues. Let it be capable of calling the hankerings of the aggrieved retirees a day. The enormous plights of the pensioners belonging to State Bank of India have a long history of callousness meted out to them at the hands of Government and the SBI management. K.R. Saini, the key spokesman on behalf of the retiree pensioners, has been writing a full fledged series of literature on the intricacies of the subject in this blog and the latest one as an elaborate comment is reproduced below for the benefit of the readers.   • SO FAR AS THE 7TH BIPARTITE RETIREES’ PENSION ISSUE IN S.B.I. IS CONCERNED, RELIANCE IS PLACED ON A.I.R 1983 S.C 130 (SUPREME COURT JUDGMENT) FOR THE PROPOSITION THAT “PENSION IS NO LONGER A BOUNTY BUT IS A RIGHT GOVERNED BY PENSION RULES.”. ALTHOUGH PENSION HAS BEEN PAID TO THE 7TH BIPARTITE RETIREES OF S.B.I,HOWEVER,IT HAS BEEN CALCULATED ON THE BASIS OF PAY UNDER THE 6TH BIPARTITE SETTLEMENT IS UNJUSTIFIED. QUESTION IS THAT THE ONLY ISSUE THAT NEEDS TO BE CONSIDERD IS WITH REGARD TO PAY ON THE BASIS OF WHICH THE PENSIONARY BENEFITS ARE TO BE CALCULATED TO 7TH BIPARTITE RETIREES.
    THE 7TH BIPARTITE SETTLEMENT IS DATED THE 19TH MAY 2000 AND CLAUSE 16 OF THIS SETTLEMENT SPECIFICALLY PROVIDES THAT PAY FOR THE PURPOSES OF PENSION IS THE AMOUNT DRAWN IN TERMS OF 6TH BIPARTITE SETTLEMENT.BUT THIS CLAUSE 16 IS SUBJECT TO THE AMENDMENTS THAT MAY BE MADE TO PROVISIONS OF 1995 REGULATIONS.IN THE CASE OF S.B.I CASE 1995 REGULATIONS HAVE NO APPLICATION AS ALL THE EMPLOYEES OF STATE BANK OF INDIA ARE GOVERNED BY THE 1955 RULES(S.B.I EMPLOYEES PENSION FUND RULES.).AS PAY FOR PURPOSES OF PENSION IS THE 6TH BIPARTITE SETTLEMENT SUBJECT TO THE AMENDMENT OF REGULATIONS 1955,WHICH ARE THE STATUTORY PENSION RULES(STATE BANK OF INDIA EMPLOYEES PENSION FUND RULES) AND IN THE CASE OF 7TH BIPARTITE RETIREES ,THERE ARE NO AMENDMENTS MADE IN S.BI EMPLOYEES PENSION FUND RULES.BUT BANK’S PLEA IN THE HIGH COURTS THAT THE PENSION RULES 1955 HAVE BEEN AMENDED AS WELL APPEAR FROM THE GAZETTE NOTIFICATION DATED THE 16TH SEPTEMBER 2000 AND THEN AGAIN GAZETTE NOTIFICATION DATED THE 31ST MARCH’ 2001.BUT THESE TWO NOTIFICATIONS ARE ADMINISTRATIVE DECISIONS NOT AMENTMENTS IN 1955 RULES.BECAUSE THERE IS NO AMENDMENT TO STATUTORY RULES THAT IS ”PENSION IS TO BE PAID ON THE LAST 12 MONTHS AVERAGE PAY NOT ON THE PRE REVISED PAY OF 6TH BIPARTITE SETTLEMENT.”IN THE 7TH BIPARTITE SETTLEMENT APPLICATION OF 6TH BIPARTITE SETTLEMENT PAY HAS BEEN MADE FOR PURPOSES OF ASCERTAINING PAY THIS AGAIN IS SUBJECT TO AMENDMENT.
    ALL THE 7TH BIPARTITE RETIREES RETIRED BETWEEN 1.11.1997 TO 31.10.2002 BY WHICH TIME THE 7TH BIPARTITE SETTLEMENT WAS IN EXISTENCE AND REVISION OF PAY HAD ALSO BEEN EFFECTED.IN FACT,AT TGE TIME OF RETIREMENT(S) ALL THE PENSIONERS OF 7TH BIPARTITE SETTLEMENT WERE RECEIVING THE REVISED PAY UNDER THE 7TH BIPARTITE WERE RECEIVING THE REVISED PAY UNDER THE 7TH BIPARTITE SETTLEMENT.THEREFORE THIS OUGHT TO HAVE BEEN MADE THE BASIS WHILE CALCULATING THE PENSIONARY BENEFITS,THE 7TH BIPARTITE SETTLEMENT CAME INTO EFFECT ON AND FROM 1ST NOVEMBER,1997 FOR A PERIOD OF 5 YEARS I.E TILL 31.10.2002.RULE 23 OF 1955 RULES SAYS AN AVERAGE TO BE TAKEN OF THE LAST 12 MONTHS.IN THE LAST 12 MONTHS,7TH BIPARTITE SETTLEMENT AND PAY FOR 7TH BIPARTITE SETTLEMENT AND THEREFORE,THE APPLICATION OF PAY RECEIVED UNDER THE 6TH BIPARTITE SETTLEMENT BY THE BANK FOR CALCULATING THE 7TH BIPARTITE PENSIONARY BENEFITS IS UNJUSTIFIED.
    WE SHOULD CONTEND THAT ALL PENSIONERS ENTITLED TO RECEIVE PENSION UNDER THE RELEVANT S.B.I EMPLOYEES PENSION FUND RULES AND PENSIONERS ARE ONE CLASS IRRESPECTIVE OF DATE(S0 THEIR RETIREMENT AND THERE CANNOT BE MINI-CLASSIFICATION WITHIN THE CLASS THAT DIFFERNTIAL TREATMENT ACCORDED TO THOSE WHO HAD RETIRED PRIOR TO 1.11.2002 IS VIOLATE THE ARTICLE 14 AND 21 OF THE CONSTITUTION OF INDIA.
    OUR PENSIONERS FEDERATION IS FIGHTING ON THESE ARICLES IN THE HIGH COURTS FROM THE YEAR 2000 AND ALL THE CASES ARE PENDING IN THE COURTS.

    IN STATE BANK OF INDIA ,ALL THE PENSIONERS ARE BEING PAID THE PENSION ON THE BASIS OF LAST 12 MONTHS AVERAGE PAY W.E.F 1.1.1986 IN TERMS OF THE VERDICT BY SUPREME COURT ON 23.02.1989,BUT except THE 7TH BIPARTITE RETIREES.
    PENSION CANNOT BE PAID ON NOTIONAL PAY,SINGLE OUT OF TNE OF THE 7TH BIPARTITE RETIREES MAY BE VIOLATE OF ARTICLE 14 AND ARTICLE 21 OF THE CONSTITUTION OF INDIA.IT IS LEGAL,EQUITABLE AND JUSTIFIED TO PROVIDE FOR PENSION FOR THE 7TH BIPARTITE RETIREES ON THE SAME FOOTING AS THAT OF 8TH AND 9TH BIPARTITE RETIREES,DENYING THE SAME TO THESE RETIREES AMOUNTS TO DISCREMINATION.MOREOVER,PENSIO N TO 7TH BIPARTITE RETIREES IS NOT ON THE LINE OF PENSION FUND RULE 23(1) OF THE STATE BANKOF INDIA EMPLOYEES PENSION FUND RULES.

    RETIREES OF OTHER BANKS NOT FOR THE 7TH
    BIPARTITE OF STATE BANK OF INDIA.

    AS ALL OF YOU ARE AWARE THAT PAY SCALES OF DIFFERENT BIPARTITES ARE ARRIVED BY MERGING OF CONSUMER PRICE INDEX POINTS.IN THE CASE OF 6TH BIPARTITE SCALES,IT IS FRAMED BY MERGER OF 1148 POINTS AND 7TH BIPARTITE SCALES ARE FRAMED BY MERGER OF 1684 POINTS.HOWEVER,IN THE CASE OF 7TH BIPARTITE RETIREES OF OTHER BANKS,FOR THE PUPOSE OF CALCULATION OF PENSION,7TH BIPARTITE SCALES ARE FRAMED BY MERGER OF 1616 POINTS AND THAT SCALES BY MERGER OF 1616 POINTS WERE LESS THAN ACTUAL PAY SCALES OF 7TH BIPARTITE SETTLEMENT.IN OTHERBWORDS PENSIONABLE PAY BECAME LESS THAN ACTUAL PAY SCALES OF 7TH BIPARTITE SETTLEMENT.
    FURTHER,IN THE CASE OF OTHER BANKS PENSION IS PAYABLE @50% FOR ALL THE GRADES,BUT DUE TO CLAUSE 16 OF 7TH BIPARTITE SETTLEMENT,THE PENSION OF 7TH BIPARTITE RETIREES OF OTHER BANKS WERE REDUCED TO 43% OF THE PAY.BUT THIS ANOMALY HAS BEEN SOLVED BY THE PENSIONERS OF OTHER BANKS/U.F.BU IN THE 8TH BIPARTITE SETTLEMENT AND NOW ALL THE PENSIONERS OF OTHER BANKS ,PENSION ON THE BASIS OF PAYBSCALES OF 7TH BIPARTITE RETIREES W.E.F 1.05.2005.
    NOW ,SUPREME COURT IN ITS JUDGEMENT DATED 13.02.2014 HAS ALSO DIRECT SOME BANKS TO PAY PENSION TO 7TH BIPARTITE RETIREES FROM THEIR DATE(S) OF RETIREMENTS(S) TO 30.04.2005 ONTHE BASIS OF PAY SCALES OF 7TH BIPARTITE BY MERGER OF 1616 TO1684 POINTS.
    UNDER THESE DEVELOPMENTS,IT MAY BE POSSIBLE NOW I.B.A MAY BREOPEN THE 7TH BIPARTITE SETTLEMENT DUE TO THIS JUDGEMENT FOR THE BENEFIT OF 7TH BIPARTITE RETIREES OF OTHER BANKS.
    BUT IN STATE BANK OF INDIA PENSION TO 7TH BIPARTITE RETIREES ARE BEING PAID ON THE BASIS OF 6TH BIPARTITE PAYSCALES.

    LAST12 MONTHS SALARY TO ALL ELLIGIBLE PENSIONERS FROMN THE DATE(S) OF THEIR RETIREMENT(S) ,NEXT DATE OF HEARING IS 29TH JANUARY 2015.LET US HOPE FOR THE BEST.

Is there any truth on news that d 7th Bypartities demands were not considered because d chunk of persioners ( those who retired from 1/11/1997 to 1/11/2002 ) retired under d VRS and they have received d benefits of salary for the remaining service period & pension payment also started from next onwards (for which they have received salary )
    Is it correct.?
    Then why Bank and govt ignored the normal retirees those who were not got any additional benefit.

    FIRST RECOMMENDATIONS FOR REVISION OF PENSION FOR 7TH BIPARTITE RETIREES WAS SENT TO THE GOVERNMENT BY THE BANK ON THE 26TH JULY ,2000 IMMEDIATELY ON THE RECEIPT THE APPROVAL FROM GOVERNMENT FOR 6TH BIPARTITE RETIREES ON THE BASIS OF 50%/40% W.E.F1.03.1999 ON THE SAME FORMULA OF 50%/40% W.E.F 1.3.1999.IN THIS CONNECTION,A RESULATION WAS PASSED IN THE CENTRAL BOARD ON THE 26TH JULY 2000 FORBREVISION OFBPENSION FOR 6THAND 7TH BIPARTITE RETIREES.RECOMMENDATIONS FOR BREVISION OFB PENSION OF 7TH BIPARTITE RETIREES WAS ALSO W.E.F 1.3.1999.THAT RECOMMENDATIONS FOR 7THBIPARTITE RETIREES WAS AS UNDER.

    THE SAME RECOMMENDATIONS WAS SENT IN APRIL ,2006 AFTER THESTRIKE IN SB.IIN APRIL 2006 FOR REVISION OF PENSION FOR 7THY BIPARTITEES AND ALSO RECOMMENDEDS FOR REVISION OF PENSION FOR 8TH BIPARTITE RETIREES.RECOMMENDATIONS FOR THEV7TH AND 8TH BIPARTITE RETIREES W.E.F 1.05.2005. BUT GOVERNMENT APPROVE/SANCTION THE RECOMMENDATIONS FOR 8TH BIPARTITE RETIREES W.E.F 1.5.2005 ONLY.7TH BIPARTITE RETIREES WERE LEFT OUT FOR REVISION OF PENSION.HOW IS GOVERNMENT IS ADAMANT NOT TO REVISE THE PENSION OF 7TH BIPARTITE RETIREES IN S.B.I.FIRST RECOMMENDATIONS FOR REVISION OF PENSION OF 7TH BIPARTITE RETIREES WAS W.E.F 1.3.1999 AND SUBSEQUENTLY IT WAS W.E,F 1,5,2005 ERESWHILE CHAIRMAN SHRI O.P BHATT HAD SENT THE SAME RECOMMENDATIONS FOR 7THBIPARTITE RETIREES TWICE IN 2008 AND AGAIN ONE TIME IN 2010 BUT GOVERNMENT DID NOT ACCORD THE SANCTION.
    NOW,ALL THE 7TH BIPARTITE RETIREES ARE IN THE RANGE OF 70YEARS TO 77 YEARS OLD.SOME OF 7THN BIPARTITE RETIREES HAD DIED AND THE REMAINING SURVIVOR OF 7TH BIPARTITE RETIREES ARE NOT HAVING GOOD HEALTH DUE TO THEIR ADVANCED AGE.THIS IS THE CONDITION OF 7TH BIPARTITE RETIREES IN S.B.I.THEY ARE ALSO NOT GETTING 100% D.A NEUTRALIZATION.THUS GRAVE INJUSTICE HAS BEEN DONE BY THE GOVERNMENT TO 7THBIPARTITE RETIREES IN S.B.I.I AM ALSO NOW 74 YEARS OLD AND HAS BEEN RETIRED AFTEBCOMPLETING 60 YEARS OF AGE ,IN OTHER WORDS I AM ALSO A NORMAL RETIREE AND A SUFFERER OF THIS GRAVE INJUSTICE.
    IT IS OUR MISFORTUNE THAT DESPITE BEST EFFORTS FROM ALL CONCERNED INCLUDING STATE BANK OF INDIA TO REMOVE THIS ANOMALY.THE BGOVERNMENT OF INDIA HAD ALREADY DECIDED TO CLOSE THIS MATTER IN MAY,2011 AND NOT WANT TO REOPEN THIS ISSUE AT ANY COST.

    You have covered the plight of SBI Pensioners and the legal aspects of our legitimate claim in detail and many many thanks for your sincere efforts. My question is ” How long we can wait”. It is already 14 years we are struggling for justice. Also we have lost more than Rs.1.5 lacs by way of DA from the year 2005.
    Delhi High Court is a puppet in the hands of politicians and buerocrats,the judges showing no guts to give justice.
    I think it is high time we should all unite and fix a day for a rally in New Delhi and meet the PM and FM for immediate justice.

AS YOU ARE AWARE THAT A NUMBER OF COURT CASES HAVE BEEN FILED IN DIFFERENT HIGH COURTS OF THE COUNTRY FOR REVISION OF PENSION FOR 7TH BIPARTITE RETIREES AND SOME OF THE HIGH COURTS GAVE VERDICS IN FAVOUR OF THE PETITIONERS(7TH BIPARTITE RETIREES) AND SOME HIGH COURTS GAVE VERDICS AGAINST THE RETIREES.
    WHEN I GO THROGH THESE JUDGEMENTS I FIND THAT THE BANKS PLEA IN THE COURTS IS SIMILAR TO FIVE INSURANCE COMPANIES IN THE SUPREME COURT JUDGEMET DATED 7.1.2015 AS STATED ABOVE.IT WAS STATED BY THE BANK IN COURT CASES THAT PERSONS WHO HAVE RETIRED UNDER V.R.S SCHEME AND THEY CANNOT COMPARE THEMSELVES WITH PERSONS WHO RETIRED NORMAL COURSE AS PER PENSION RULES.IT WAS FURTHER STATED THAT THE SBI EMPLOYEES PENSION FUND RULES WERE FRAMED INN EXCERCISE OF POWER CONFERRED BY SECTION 50 OF THE SBI ACT,1955 BY THE CENTRAL BOARD AFTER CONSULTATION WITH THE RESERVE BANK OF INDIA AND AFTER OBTAINING SANCTION OF THE CENTRAL GOVERNMENT AND THAT THE RULES HAVE BEEN IN FORCE FROM 1.7.1955.THE RULES ARE STATUTORY IN CHARACTER.THEREFORE THE DEMAND OF THE PETITIONERS(7TH BIPARTITE RETIREES) CANNOT BE GRANTED.THEREFORE ,ANYAMENDMENT ALSO REQUIRES APPROPRIATE APPROVAL BY THE CENTRAL GOVERNMENT.THOUGH THE BANK HAS RECOMMENDED TO THE CENTRAL GOVERNMENT FOR REVISION OF PENSION OF 7TH BIPARTITE RETIREES AGAIN AND AGAIN,UNTIL SUCH TIME THE CENTRAL GOVERNMENT GIVES APPROVAL FOR REVISION OF PENSION FOR 7TH BIPARTITE RETIREES.
    AFTER THE ABOVE JUGEMENT SOME HOPE ARISES FOR NORMAL RETIREES OF 7TH BIPARTITE SETTLEMENT BUT SUBJECT TO THE APPROVAL OF CENTRAL GOVERNMENT FOR THEM.

SHRI RAMESH.N, KINDLY AGAIN GO THROUH THE JUDGEMENT OF THE SUPREME COURT OF INDIA DATED THE 7TH JANUARY,2015 AND YOU WILL FIND THAT THE CASE OF G.I.C DEALT WITH THOSE SPECIAL VRS SCHEME RETIRED IN 2004 UNDER VRS AND JUDGEMENT APPLIES ONLY TO THAT PARTICULAR WAGE REVISION RETROSPECTLY FROM EARLIER TO 2004 AND NOTIFIED IN 2005 IN THE OFFICIAL GAZETTE BUT JUDGEMENT IS NOT DEALT WITH PENSION UPDATION AND MORE SO.SVRS EMPLOYEES DEMANDED THAT THEY SHOULD GET THE REVISION OF PENSION ON THE BASIS OF REVISED PAY.THIS JUDGEMENT DOES NOT APPLY TO BANK EMPLOYEES OR THEIR UPDATION.HOWEVER, THIS JUDGEMENT CAN BE QUOTED IN FUTURE BECAUSE THIS JUDGEMENT IS REPORTABLE ONE.

  15. TEANSFER PETITIONS FILED BY STATE BANK OF INDIA IN THE SUPREME COURTIN RESPECT OF 7TH BIPARTITE RETIREES.
    AS YOU ARE AWARE THAT SOME OF THE PENSIONERS OF OUR BANKRETIRED DRAWING THE 7TH BIPARTITE PAY SCALES AT THE TIME OF THEIR RETIREMENT AGGRIEVED BY THE DENIAL OF THEIR PENSION COMPUTED ON THE BASIS ACTUAL PAY BY THEM THEN HAVE RESORTED TO FILING WRIT PETITION IN MADRAS HIGH COURT IN 2001.THIS WRIT PETITION WAS DECIDED BY MADRAS HIGH COURT ON 16.10.2008 IN FAVOUR OF 7THBIPARTITE RETIREES GAVE DIRECTION TO GOVERNMENT FOR CONSIDERATION OF PENSION OF 7TH BIPARTITE RETIREES ON THE LINES TO 8TH BIPARTITE RETIREES.
    ANOTHER NUMBER/GROUP OF 7TH BIPARTITE RETIREES ALSO FILED WRIT PETITIONS IN 2002 AND 2003 INTHE SAME NADRAS HIGH COURT ON THE SAME ABOVE NOTED ISSUE.BUT THE SAME MADRAS HIGH COURT GAVE VERDICT ON 8.06.2010 AGAINST THE PENSIONERS THAT COURT CANNOT GAVE INSTRUCTIONS TO GOVERNMENT.IN THE REVIEW PETITIONS FILED IN MADRAS HIGH COURT BANK SAID THEY ARE FILING TRANSFER PETITIONS IN THE SUPREME COURT AFTERTHIS SUBMISSION OUR BANK FILED TRANSFER PETITIONS IN SUPREME COURT IN 2013 TRANSFER PETITION(CIVIL) NO 750 -758 FOR ALL THE CASES PENDING BEFORE MADRAS HIGHCOURT.AFTER ABOUT TWO YEARS THE FATE OF THESE PETITIONS ARE THAT IT IS STILL PENDING BEFORE THE REGISTRAR OF THE SUPREME COURT LAST DATE OF HEARING WAS 22.09.2014 AND NO FURTHER DATE OF HEARING HAS BEEN FIXED BYTHE SUPREME COURTSO FAR..

IN STATE BANK OF INDIA,THE AMOUNT OF PENSION IS NOT REVISED AUTOMATICALLY AFTER EACH SETTLEMENT AND AFTER EACH BIPARTITE SETTLEMENT FOR WAGE REVISION,THE BANK HAS TO OBTAIN THE SANCTION OF GOVERNMENTOF INDIA TO INDEXED THE PENSION TO THE REVISED SALARY.THE PRESENT STATUS OF 7TH BIPARTITE RETIREES IN SB.I IS THAT GOVERNMENT HAS NOT ACCORDED THE SANCTION/APPROVAL FOR REVISION OF PENSION FOR 7TH BIPARTITE RETIREES IN S.B.I.THIS ISSUE CAN BE SOLVED ONLY WITH THE SANCTION OF GOVERNMENT OF INDIA.AND IT APPEARS AT PRESENT THAT GOVERNMENT IS NOT IN A MOOD TO REVISE THE PENSION OF 7TH BIPARTITE RETIREES DESPITE MANY RECOMMENDATIONS BY THE BANK TO GOVERNMENT OR THE VERDICS OF VARIOUS HIGH COURTS IN FAVOUR OF 7TH BIPARTITE BRETIREES.

    1. Nobody is able to explain d exact reasons for such a negative attitude taken by UPA as well as d present NDA Governments towards 7th bypartites Pensioners.
      Actually this negative approch might have been generated from d part of Finance Department itself.While bombarding d entire 7th bypartites as VRS pensioners quited their service after receiving huge sums as compensation, they ( thappanas in finance dept) should bear in mind that all d 7th bypartite pensioners are not VRS pensioners as you are propagating.It includes a lot of pensioners who retired on completion of sixty years without receiving any additional monetary benefits as that of VRS.It is d apt time for putting our full effort to score a goal

IN RESPONSE TO WRITE UP DATED THE 20TH JANUARY 2015 BY SHRI RAMESH .NEELKANTAN,IT IS A FACT THAT THE 7TH BIPARTITE RETIREES WHO RETIRED IN THE CURRENCY OF 7TH BIPARTITE SETTLEMENT I.E DURING 1997/1998 TO 31.10.2002 WHETHER THEY RETIRED ON SUPERANNUATED OR UNDER VRS ARE THE SUFFERER.FURTHER ALL RETIREES WHETHER AWARD STAFF OR SUPERVISING STAFF WHO RETIRED DURING THE 7TH BIPARTITE SETTLEMENT ARE SUFFERER.HOWEVER THIS TYPE OF ANOMALY IN OTHER BANKS HAS ALREADY BEEN SOLVED W.E.F 1.5.2005.
    WHAT A WONDERFUL ANOMALY OF 7TH BIPARTITE RETIREES IN S.B.I.
    ALL OF THE 7TH BIPARTITE RETIREES —-FAMILY PENSION IS PAYABLE ON THE BASIS OF 7TH BIPARTITE PAY SCALES,PROVIDENT FUND IS CALCULATED UP TO DATE OF RETIREMENT INCLUDING 7TH BIPARTITE PAY SCALES,GRATUITY IS ALSO CALCULATED ON THE REVISED SALARY OF 7TH BIPARTITE PAY SCALES.BUT BASIC PENSION TO 7TH BIPARTITE RETIREES IS PAYABLE ON THE BASIS OF PAY SCALES OF 6TH BIPARTITE SETTLEMENT.ALL PENSIONERS OF S.B.I ARE DRAWING PENSION ON THE BASIS OF LAST 12 MONTHS AVERAGE SALAY W.E.F 1.1.1986 EXCEPT 7TH BIPARTITE RETIREES WHO ARE STILL GETTING PENSION ON THE BASIS OF 6TH BIPARTITE SETTLEMENT.ALL 7TH BIPARTITE RETIREES ARE NOW ABOVE 70 YEARS TO 77 YEARS OLD.
    ALL THE ABOVE NOTED FACTS ARE IN THE KNOWLEDGE OF BANK,GOVERNMENT OF INDIA AND OUR PENSIONERS FEDERATION SO MUCH SO GOVERNMENT OF INDIA DO NOT WANT TO REVISE THE PENSION 7TH BIPARTITE RETIREES AND CONVEY TOTHE BANK TO CLOSE THIS MATTER IN MAY2011.

I ADVISE THAT PENSION SCHEME IN SBI IS GOVERNED BY STATE BANK OF INDIA EMPLOYEES PENSION FUND RULEs AND ANYAMENDMENTS IN THESE RULES REQUIRED THE SANCTION/APPROVAL OF GOVERNMENT OF INDIA AND IN THE CASE OF 7TH BIPARTITE RETIREES NO AMENDMENT IN THESE RULES APPROVED BY THE GOVERNMENT SINCE 1.3.1999.EVERY AMENDMENT IN THE RULES ARE NOTIFIED IN THE OFFICIAL GAZETTE OF GOVERNMENT OF INDIA and each amendment is placed before the lok SABHA AND RAJYA SABH OF THE PARLIAMENT.USALLY EVERY BIPARTITE HAS ONE NOTIFICATION FOR PROVIDING PENSION TO EMPLOYEES .BUT 7TH BIPARTITE SETTLEMENT HAVE TWO NOTIFICATION S ONE ON 16.09.2000 AND OTHER WAS ON 31.03.2001 .THIS SHOWS MALAFIDE ATTENTION OF THE GOVERNMENT.THE SECOND NOTIFICATION ON THE SAME NOTIFICATIONLINES W.E.F 1.03.1999 WAS TO CURB THE REVISION OF PENSION FOR 7TH BIPARTITE DUE TO VRS.IMPLEMENTATION w.e.f 1.04.2001.

IT IS MATTER OF SERIOUS CONCERN THAT ALLTHE 7TH BIPARTITE RETIREES IN S.B.IARE GETTING BASIC PENSION IN THE RANGE OF RS 4250/TO RS5920/ AND 95% OF THE 7TH BIPARTITE RETIREES ARE DRWING TOTALPENSION INCLUDING D.A LESS THAN RS19000/PER MONTH DURING THIS PERIOD OF HIGH INFLATION AND DURINGTHEIR ADVANCED AGE ABOVE 70 YEARS OLD WHEN THEY NEED MEDICAL CARE MORE.THIS IS THE CONDITION OF OLD SENIOR CITIZENS.

      I never underwrite d efforts taken by our Federation for getting a solution on d 7th bypartite pensioners’ pension fixation anomaly.At present d entire focuss is on getting a periodical updation of pension for all retired prior to 2002 by forgetting that a section of pensioners called 7th bypartites were actually denied d right quantum of eligible pension as their pension is fixed on the baisis of 6th bypartite salary scale.Let the Organisation proceed with legal fighting.
      Sir, In the meantime I think it will have some momentum if we all d 7th bypartite pensioners of sbi send an individual appeal to our Prime Minister with a request for his intervention.
      If you feel d idea is not bad please draft a suitable representation detailing all facts so as we can persue our 7th bypartite comerades for sending it on individual basis.
