It’s a day for pensioners, hence too special a day for them:



Not only just an annual ritual like several anniversaries, let Pensioners Day to-day be taken in more serious a measure stand as it does on a crossroad most suspense fully waiting for a verdict on pension issues licking the dust in different courts of law in the country for decades, an abnormal delay worth a deep repugnance. There is no stone unturned to secure an early dispensation of the most procrastinated an issue like pension but pensioners themselves are to be adequately on their guard not wasting a single day to mobilise the requisite awareness amongst the quarters that count. The New Year 2015, let us wish, dawns with an augury  that delivers the pensioners the much awaited outcome.

  • AS ALL ARE AWARE,PENSIONERS ORGANISATIONS IN THE COUNTRY CELEBERATE 17TH DECEMBER IS A PENSIONERS DAY EVERY YEAR.IT WAS ON THE 17TH DECEMBER 1982,HON SUPREME COURT OF INDIA MADE A LANDMARK JUDGMENT IN THE CASE OF D.S NAKRA AND OTHERS V/S UNION OF INDIA,WHICH HELD THAT ”PENSION IS NEITHER A BOUNTY NOR A MATTER OF GRACE DEPENDING UPON SWEET WILL OF THE EMPLOYER.IT IS NOT EX GRATIA PAYMENT,BUT A PAYMENT FOR PAST SERVICES RENDERED.”
    PENSIONERS IN INDIA,CELEBERATING DAY SO AS TO SALUTE AND REMEMBER,,WITH GRATEFULNESS,THE LATE D.S.NAKRA THROUGH THIS JUDGMENT.THE PETITIONER OF THE CASE,SHRI D.S NAKRA WAS A RETIRED FINANCIAL ADVISOR IN THE MINISTRY OF FINANCE.
    AS IN THE CASE OF GOVERNMENT PENSIONERS,SBI PENSIONERS HAVE NOT MUCH TO REJOICE EVEN AFTER 27 YEARS IN THE CASE OF 5TH BIPARTITE RETIREES WHO ARE NOW ABOVE 82 YEARS TO 87 YEARS OLD AND WHO ARE NOW IN HUNDREDS NOT IN THOUSAND.IN THEIR CASE MAXIMUM BASIC PENSION IS RS2400/PER MONTH.SIMILARLY EVEN AFTER 17 YEARS IN THE CASE OF 7TH BIPARTITE RETIREES ARE NOT GETTING FULL BASIC PENSION AND AT PRESENT BOTH 5TH AND 7TH BIPARTITE RETIREES ARE GETTING PENSION @28% OF THE LAST DRAWN PAY AT THE TIME OF THEIR RETIREMENT(S). ALL THE RETIREES OF 5TH,6TH AND 7TH BIPARTITE RETIREES ARE NOT GETTING 100% D.A NEUTRALISATION.THUS ALL THE VERY SENIOR PENSIONERS ABOVE THE AGE OF 70 YEARS TO 87 YEARS OLD ARE THE MOST SUFFERER.

    PENSION IS A RIGHT TO LIFE AND DECEMBER 17 IS CELEBERATED AS” PENSIONERS’ DAY”ACROSS THE NATION.IT WAS ON THIS DAY IN 1982,PENSION WAS DEFINED OF A ”DEFFERRED WAGE”PAYABLE TO THE RETIREE TILL THE DATE OF DEATH BY THE SUPREME COURT,WHICH FURTHER DECLARED THAT GRANT OF PENSION IS NOT A BOUNTY BUT A RIGHT AND SOCIAL OBLIGATION OF THE GOVERNMENT UNDER THE CONSTITUTION.IN ANOTHER JUDGEMENT,THE COURT LAID DOWN THAT NO DISCREMINAION IN THE MATTER OF PENSION BENIFITS CAN BE METED OUT TO PENSIONERS MERELY ON THE BASIS OF THE DATE OF RETIREMENT—BUT IN STATE BANK OF INDIA A GRAVE INJUSTICE HAS BEEN DONE TO 7TH BIPARTITE RETIREES AND HAS BEEN DISCREMINATED FOR NOT REVISING THE PENSION ON THE BASIS OF THEIR PAY AT THE TIME OF RETIREMENT..PENSION IS A VITAL ASPECT OF SOCIAL SECURITY AND THE RIGHT TO RECEIVE IT CONSTITUTES A RIGHT TO LIFE UNDER THE CONSTITUTION.TO DEPRIVE A PENSIONER OF THE PAYMENT OF PENSION IS TO DEPRIVE HIM OR HER THE RIGHT TO LIFE.DELAYED PENSION PAYMENTS PLACE A PENSIONER IN IN A POSITION OF UNCERTAINTY AND DEPENDENCE WHICH INPINGES ON THE QUILITY OF LIFE UNDER ARTICLE 21 OF THE CONSTITUTION AND RIGHT TO DIGNIFIED EXISTENCE OF THE AGED.THIS MEANS PENSIONERS COULD NOT BE LEFT TO THE MERCY OF THE ADMINISTRATION TO RECEIVE WHAT A MATTER OF RIGHT.IN THE LIGHT OF THESE JUDGEMENTS,PENSIONERS A PART OF RIGHT TO LIFE AND THE GOVERNMENT OF THE DAY SHOULD ACCEPT THE REALITY AND NOT ENCROACH UPON THE RIGHT TO LIFE OF THE PENSIONERS.THUS PENSIONERS MUST LEAD THEIR LIVES WITH SENSE OF RESPECT AND DIGNITY.   3. Mr Saini my sincere thanks once again for the comments,.All our vies and efforts expressed through Sh Neelkanthji might give the fruit one day . my feeling is that this govt is not the govt of the people ,but of some hungry and power seeking
    people,who never having hope to get the power so soon, and Mr Saini’s expression and Mr Neelkanth’s views will not reach into the deaf ears of the administration and their channels to get the full details of the Bank pensioners specially the 7th Bipartite retirees from the State Bank Of India,The CEO of the State Bank Of India is much worried about the Low salary of bankers but has never spoken a single word about the S.B.I pensioners, who have given their life for the banks.. The pensions being paid to the S.B.I.pensioners in 7th bipartite retirees is Basic maximum Rs 4250/- + D.A. , is not enough for the payment of Rent of the two room set to live in. .Rest I put every thing on the readers to decide for the Govt. .Mr Modi should give specially attention on the pension issue of the banks/ specially the 7th Bipartite retirees of the State Bank Of India.
