Wakeup ye pensioners, wakeup now at least:


Let it be a clarion call directed to all the pensioners being retirees from State Bank of India who for no reasons known hardly bother to worry for their own interest always caring the three hoots for themselves and their families. They are the ones who crave for a sky on earth but without striving the least in that direction. Why so? True, many of them are otherwise well placed financially with additional resources of income at the family level but they have to remember that there is a big chunk of pensioners who suffer from agonies for want of adequate means to sustain themselves and their family members in the current scenario of abnormally soaring prices. The call is not to ask them to virtually take cudgels against the Bank or the government but vigorously assert in a normal way by generating public awareness on their cause and mission. This blog has been voicing the concern of the pensioners in much louder a way drawing the attention of the authorities that be besides the same efforts having been made by the concerned unions/ Federation and it worked to a great extent but without reaching the finality in the matter yet. A veteran on pensioners cause K.R. Saini is virtually flooding most meaningful a literature on pension issues through this blog to be made good use of at the level of the retirees but his efforts go a waste for want of necessary attention paid to it by them. The time to time feedbacks he provides are significant and may work well if highlighted by the pensioners in desired proportions for the attention of the people in general and the Bank/ Government in particular. Public voice is a great weapon in any democracy and so is in India but an aggressive canvasing is the need for the purpose which task the pensioners can handle well if they opt to apply necessary will in that context. No day is the last day for a mission and there is still time for the pensioners in State Bank to ‘rise and awake and stop not till the goal is achieved’. There are regular updates on pension issues in ‘NewsPage’ of this blog duly contributed mainly by K.R. Saini and the contents warrant that they be properly used at least by the pensioners themselves to highlight the mission. This done, it is sure to generate necessary climate in favour of the retiree pensioners. Appeal to accelerate the move on the part of the pensioners is reiterated as it is never too late to mend.

IN THIS CONTEXT,I HAVE TRIED PROB THE REASONS FOR DELAY OF 16 YEARS IN THIS REGARD, I SOME HOW STUMBLE ON THE REASON THAT WE ARE ALSO RESPONSIBLE TO SOME EXTENT FOR THIS DELAY.COURT CASE CAN BE FILED IN 2001 WHICH HAS BEEN FILED IN 2011. THIS COULD BE DUE TO THE GENERAL APATHY AND CASUAL ATTITUDES ON THE PART OF OUR SENIOR LAWYERS WHO SOMETIME DO NOT ATTEND THE COURT PROCEEDINGS ON THE DATES AND DO NOT ARM THEMSELVES WITH HARD FACTS TO COUNTER THE ARGUMENTS GIVEN BY THE GOVERNMENT AND BANK.THE PERUSAL OF COURT PROCEEDINGS IN VARIOUS COURTS CASES PENDING IN VARIOUS COURTS WELL BEAR OUT MY PRESUMPTION ABOUT CONDUCT OF CASES BY THE SENIOR LAWYERS.
    ALSO THERE APPEARS TO BE LESS OF PATIENCE/INTEREST DUE TO LONG TIME DELAYS ON THE PART OF PAST RETIREES WHO ARE NOW IN AGE GROUP OF 70 YEARS TO 86 YEARS
    HOWEVER OUR PENSIONERS FEDERATION CONTINUES TO ATTEND THE COURT PROCEEDINGS WITH CONCRETE EFFORTS TO SECURE THE FAVORABLE JUDGMENTS FROM VARIOUS COURTS. K.R SAINI

A BIG CHUNK OF PENSIONERS CONSIST OF THOSE WHO RETIRED FROM THE BANK’S SERVICE IN THE 8TH AND 9TH BIPARTITE SETTLEMENTS.THEY ARE BETTER PLACED PENSIONERS DUE TO MORE SUPERANNUATION BENEFITS LIKE GRATUITY,PROVIDENT FUND,LEAVE ENCASHMENT .MORE OVER,THEY ARE ALSO GETTING 100% D.A NEUTRALIZATION ON BASIC PENSION AND THEY MANAGE WELL MAINTAIN OF THEMSELVES AND THEIR FAMILIES,WITHOUT ANY INTEREST FOR ENHANCEMENT IN PENSION.BUT THIS POSITION DOES NOT APPLIES TO 5TH,6TH AND 7TH BIPARTITE RETIREES ,WITH BTHE DIFFERENCE THAT AMOUNT THEY DRAW LESS COMPARED TO RECENT RETIREES.   5. IT MAY BE ONE REASON THAT PENSIONERS ARE NOT TAKING INTEREST DUE TO OUR LEGAL JUSTICE SYSTEM UNFORTUNATELY IS DELIBERATELY
    BEING SUBJECTED TO VEXATIOUS LITIGATION BY OUR POWERFUL EMPLOYER-OUR BANK AND THE GOVERNMENT.THE RECENT EVENTS ESTABLISH BEYOND ANY DOUBT THAT OUR BANK AND THE GOVERNMENT ARE ONLY KEEN ON PERPETUATION OUR PENSION ISSUES TO REMAIN IN THE DOMAIN OF LITIGATION.
    IN THIS CONTEXT I AM GOING TO GIVE THREE EXAMPLES OF COURT CASES FILED IN 2001,2003 AND 2009.MADRAS HIGH COURT CASE (FILED IN 2001) GAVE VERDICT IN FAVOUR OF 7TH BIPARTITE RETIREES ON 16.10.2008 BUT THE GOVERNMENT HAS NOT IMPLEMENTED THE COURT DECISION AND BANK FILED TRANSFER PETITIONS IN THE SUPREME COURT(transfer appeals 750-758)/2013) and is pending with the registrar of supreme court for the last one year.SIMILARLY KERALA HIGH COURT CASE(FILED IN 2003) HAS ALSO GIVEN VERDICT IN FAVOR OF 7TH BIPARTITE RETIREES IN SEPTEMBER 2010.THIS DECISION IS BY A SINGLE JUDGE BUT UP TO NOW THE CASE HAS NOT BEEN HEARD BY DOUBLE BENCH AND HAS NOT BEEN IMPLEMENTED. A COURT CASE AT CALCUTTA HIGH COURT(FILED IN 2009) HAS ALSO GIVEN VERDICT IN FAVOUR OF AN AWARD STAFF EMPLOYEE(7TH BIPARTITE RETIREE) IN SEPTEMBER 2012.THIS DECISION OFTHE CALCUTTA HIGHBCOURT IS ALSO NOT IMPLEMENTED.K.R SAINI

IT IS MOST UNFORTUNATE THAT OUR BANK ACTS AGAINST ITS OWN CONSCIENCE ,DICTATED BY THE BUREAUCRACY WHICH IS ONLY PERPETUATING ITS UNJUST DECISIONS AND DEPRIVING FROM GETTING OUR LEGITIMATE PENSION BENEFITS.THE WELL ESTABLISHED BASIS OF COMPUTING PENSION ON THE LAST 12 MONTHS AVERAGE PAY WAS NOT FOLLOWED IN THE CASE OF 7TH BIPARTITE RETIREES AND DEPRIVING THEM THE ENTITLED PENSION OF ABOUT 25000 PENSIONERS(7TH BIPARTITE RETIREES).A NUMBER OF PENSIONERS LIVING IN DIFFERENT PART OF THE COUNTRY WERE FORCED TO RESORT TO SEVERAL WRIT PETITIONS IN DIFFERENT HIGH COURTS FOR SEEKING JUSTICE.
    OUR PENSIONERS’ FEDERATION IS ALSO TRYING FOR RESOLVING THE PENSION ISSUES FOR THE LAST 14 YEARS. K.R SAINI

  8. The Finance Ministeries approval to the recommendations of the IBA in case of payment of 100% neutralisation of the DA to the pre 1/11/2002 retirees is still awaited. It needs to be vigoriously persuaded and followed up with the ministry by our Federation through the IBA. Shri K. R. Saini may kindly use his good offices in this behalf. IN RESPONSE TO SHRI AWADESH WRITE UP DATED 29.07.2014,I WOULD LIKE TO STATE THAT ALL POSSIBLE STEPS ARE TAKING BY OUR PENSIONERS FEDERATION BY TAKING UP THE MATTER WITH THE PRIME MINISTER,I.B.A,MINISTRY OF FINANCE ,SECRETARY FINANCIAL SERVICES.AS YOU ARE AWARE THAT THERE ARE PENDING COURT CASES IN THE VARIOUS HIGH COURTS THROUGH OUT THE COUNTRY BY THE BANK RETIREES ,BUT ARE BEING FOLLOWED-UP VIGOROUSLY BY OUR PENSIONERS’ ASSOCIATIONS/FEDERATION TO GET JUSTICE.THE FIGHT IS CON FOR THE PAST 14 YEARS AND WILL CONTINUE TILL THE ISSUES ARE DECIDED.

  11. Sir, you have rightly narrated the inner side of the pensioners.The pensioners have waited and waited for fourteen years and nothing positive has come out. Sh K.R.Saini and yourself have written many blogs on this issue but no action from any side. The Supreme-court also has failed to stict on hid order for the Delhi High court to decide the case of State Bank Of India with in six months , but there is no supervision on the Delhi Hgh court proceedings. One case of Smt Premvati bagga reffered in 2002 by seven pensioners and only three are alive, but no progress or result of the case. Our Govt is not govt for the people but only for the members of the parliament.for the increase in their salaries and Bhatas. We have a hope on Mr Modi , and if no reply or action from Mr Modi within this years , we will start aompain against N.D.A. Govt as we have already started against Mr Chidambaram the Finance-minister in U.P.A.govt. All other facts mentioned by you are correct. thanks for the blog and thanks to Mr Saini for the kind efforts for the pensioners specialy the 7th bipartite pensioners from the State Bank Of india. SHRI NEGI,THE RESOLUTION OF ALL OUR PENSION ISSUES DOES NOT INVOLVE COMPLICATED LEGAL ISSUES.THE LAWS IN THIS REGARD ARE WELL SETTLED BY THE VARIOUS PRONOUNCEMENTS BY THE SUPREME COURT.BUT, GOVERNMENT RIGID ADAMANT ATTITUDE NOT TO PROVIDE ANY IMPROVEMENT IN PENSION TO S.B.I PENSIONERS IS THE MAIN REASON THAT OUR PENSION ISSUES ARE PENDING FOR A LONG PERIOD..HOWEVER,THE FIGHT BETWEEN INDIVIDUALS AND THE GOVERNMENT/BANK I BY ANY STRETCH AN UNEQUAL BATTLE.THE INDIVIDUALS(PENSIONERS) WITH LIMITED RESOURCES CAN NEVER MATCH THE UNLIMITED RESOURCES OF THE GOVERNMENT/BANK AND THIS CONTEST IS ALWAYS ON UNEQUAL ONE.THIS MAY BE ONE REASON THAT PENSIONERS HAVE LOST PATIENCE DUE TO LONG DELAY IN RESOLUTION OF OUR PENSION ISSUES.K.R.SAINI
