SBI–Supreme Court’s verdict on pension:


If pensioners too had some god father to support them?.

Much awaited judgement in the matter of the pension case that remained pending with the Supreme Court of India for so long has since come out. They have referred the whole matter to Delhi High Court for final disposal with a note to clinch it within four months time. Delhi High Court may take their own time for the purpose and not necessary that it be finalised within the time frame so stipulated as every court has their own culture of postponing the issue on some pretext or the other like it has been happening at the level of Supreme Court. Pensioners have no kind of some lobby or the other to champion their cause and even the media, for the reasons best known to them, has all along been keeping a distance from the issue. The matter was referred to the central government through several Members of Parliament but there again nothing happened. Majority of pensioners being in the wrong side of their age, they avoid staging dharnas, picketing, demonstrations and the gheraos, the lines of the action that suits the government most, with the result that they continue to remain at the receiving end at the mercy of the Lords. Why the retiree pensioners are denied necessary relief in the name of some anomaly or the other in the matter of fitment formula?. Why they can’t be placed at par with the several other organisations in the country in a simple manner without involving this or that rigorous measure?. As if several years of waiting are not enough, the matter is referred to Delhi High Court now to be taken up afresh. May be the petitioners in either side are not required to put up their case just afresh and the material till now forming the part of the deliberations is taken as enough, the possibility of the case further lingering on can’t be ruled out. Retirees/ Pensioners are in a lurch left with no alternative but to wait and wait and continue waiting, no body knows till when?

The judiciary sytem sometimes or mostly when it is needed concludes in a very unreasonable manner so asto avoid several pressures put upon them by the other administartive systems of our country.We all know,nowadays,judges too aren’t that nobler ,if they have been earlier… for a judge its a metter of going through several amendments,procedures, old facts,and a conclusion based on the paperwork presente dto him .But for the people who fight its a matter of honor,confidence,trust ,faith and even life sometimes.Still I would hope and wish,everything will go on with a positive note and hopefully delhi court will listen and comprehend the problems of teh pensioners and shall give justice to the complaint. A ray of hope is enough through a dark night to break for its dawn.

  2. SIR, VERY SORRY STATE OF AFFAIRS. I FAIL TO UNDERSTAND WHY DID THE SUPREME COURT HEARD THE ARGUMENTS IF IT WAS NOT TO GIVE ANY JUDGEMENT AND INSTEAD REFER THE MATTER TO HIGH COURT. IT IS LIKE THAT JUDICIARY IS PLAYING MUSICAL CHAIR WITH THE ISSUE, HURTING THE SENTIMENTS OF SENIOR CITIZENS ATTACHED TO IT. AFTER FOUR MONTHS, HOPEFULLY, IF HIGH COURT GIVES ANY JUDGEMENT IN FAVOUR OF RETIRED EMPLOYEES, THE GOVERNMENT/BANK MAY AGAIN APPROACH SUPREME COURT AND IF AGAINST THE RETIRED EMPLOYEES, THEN THIS POOR LOT OF AFFECTED SENIOR CITIZENS HAVE TO AGAIN FIGHT FOR IT IN SUPREME COURT, HANGING THE ISSUE FOR ANOTHER FEW YEARS…… MAKING MOCKERY OF THE LEGAL PROCESS. AS YOU HAVE VERY RIGHTLY CONCLUDED, RETIREES/PENSIONERS ARE IN A LURCH, LEFT WITH NO ALTERNATIVE, BUT TO WAIT AND WAIT AND KEEP WAITING. GOD BLESS THE RETIREES/PENSIONERS.

  3. Sir…. It is surprising to note the developments… It was not expected.. Comments against the decisions of courts are normally avoided as they are supposed to be justified.. But this one amounts equal to the cruelty against the aged persons running from pillars to deep for justice which they rightfully deserve… You have rightly said that these old persons are being neglected as they are hesitant to adopt rowdyism to attract the attention of media, government and judiciary too…
    We once again hope that Delhi High Court will dispose the case within reasonable time and deliver the justice without further loss of time….
